Pursuant to Governor Pritzker’s Executive Order No. 2020-07 (COVID-19 Executive Order No. 5), Governor Pritzker has suspended certain rules of the Open Meetings Act – specifically the Executive Order permits remote public meetings. In light of the current COVID-19 public health emergency and the limit on public gatherings, the City Council will conduct the meeting remotely.

A. Ordinance 2020.07—An Ordinance Confirming the City of Sycamore’s Intent to Participate in the Local CURE Program. First and Second Reading.
The Local CURE Program is funded from financial assistance the State of Illinois received through the U.S. Department of the Treasury’s Coronavirus Relief Fund (CFDA No. 21.019) authorized under section 601(a) of the Social Security Act, as added by section 5001 of the Coronavirus Aid, Relief and Economic Security Act, P.L. 116-136 (“CARES Act”).
Ordinance 2020.07 confirms the City of Sycamore’s intent to participate in the reimbursement program for certain eligible expenses. As a Local Government recipient of financial support through the Local CURE program, the City of Sycamore is required to utilize the financial support received from the Illinois Department of Commerce and Economic Opportunity (the “Department”) for the specific purposes as set forth below. To participate in the Local CURE Program, the City must remain in compliance with the terms and certifications of the program.
The Local CURE program:
• Is a local government assistance program which applies to all units of local government (as defined by the Illinois Constitution) outside of Cook, Lake, Will, Kane, & DuPage counties.
• Is federally funded from the Coronavirus Relief Fund using dollars allocated to Illinois through the CARES Act.
• Will reimburse units of local government for costs that:
o are necessary expenditures incurred due to the public health emergency with respect to COVID-19;
o were not accounted for in the budget most recently approved as of March 27, 2020 (the date of enactment of the CARES Act) for the unit of local government; and
o were incurred during the period beginning March 1, 2020 and ending December 30, 2020.
Examples of costs which are eligible for reimbursement under the program:
• Medical expenses, including but not limited to; expenses of establishing temporary public medical facilities and other measures to increase COVID-19 treatment capacity, costs of providing COVID-19 testing, and emergency medical response expenses;
• Public health expenses, including but not limited to:
o expenses for communication and enforcement by local governments of public health orders related to COVID-19, including the purchase of media for public health messages related to mask wearing and social distancing,
o expenses for establishing public health programs like one to reimburse businesses for public health measures such as PPE, installation of plexiglass barriers, touchless hand sanitizer stations in public places, and other such expenses;
• Payroll expenses for public safety, public health, health care, human services, and similar employees whose services were substantially dedicated to mitigating or responding to COVID-19;
• Expenses for actions taken to facilitate compliance with COVID-19 related public health measures;
• Any other COVID-19 related expenses reasonably necessary for the unit of local government to respond to the public health emergency that satisfies the Local CURE Program eligibility criteria. Local governments must document how expenses are related to COVID-19.
Examples of costs which are ineligible for reimbursement under the program:
• Governmental revenue shortfall replacement;
• Damages covered by insurance;
• Payroll or benefits expenses for employees whose work duties are not substantially dedicated to mitigating or responding to the COVID-19 public health emergency;
• Expenses associated with the provision of economic support in connection with COVID-19;
• Reimbursement to donors for donated items or services;
• Workforce bonuses other than hazard pay or overtime;
• Severance pay;
• Legal settlements;
• Indirect costs or administrative costs; and
• Incurred expenses that have been or will be reimbursed through another State or federal funding opportunity.
In order to participate in this reimbursement opportunity, the City needs to approve this Ordinance and complete the attached Financial Support Conditions and Certification by October 1, 2020.
City Council approval is recommended.
B. Ordinance 2020.08—An Ordinance Amending Title 5, “Police Regulations”, Chapter 4, “Miscellaneous Offenses”, to Create a New Section 21, Entitled “Criminal Trespass”, in the City Code of the City of Sycamore, Illinois. First and Second Reading.
Ordinance 2020.08 would establish a local ordinance that will allow the City’s police officers to take a non-criminal approach to trespass cases of less serious transgression, while providing due process through the Administrative Adjudication system. This does not restrict officers from charging someone under the state statute of criminal trespass if appropriate.
Examples of situations where this could be used are, but not limited to:
• A person at a park or school outside of posted designated hours;
• A person fishing at a homeowner association owned pond when the Police Department receives complaints and is properly posted;
• A person at a business that has been issued a No Trespass Order or has been reasonably told to leave and refuses.
City Council approval is recommended.

13. CONSIDERATIONS
A. Consideration of a Recommendation to approve a Plat of Vacation and Dedication of Easement for NICOR Gas.
NICOR Gas is constructing a new 21,000 square foot Reporting Center at 2820 Dosen Drive in the Krpan’s Thanks America Commercial Division, Phase 5. As part of the project, a public water main must be constructed on the subject property to accommodate fire suppression equipment, including fire sprinklers and fire hydrants. Easements for the water main are proposed as are easements over detention basins to preserve these areas for stormwater management. In order to memorialize the dedication and associated easements to allow for emergency maintenance by City personnel, a Plat of Easement is required. As part of the recording process, the Mayor is required to sign the proposed plat. The proposed plat has been reviewed and approved by City Staff.
City Council approval is recommended.
