The DeKalb County Board met virtually in regular session through a cloud-based, peer-to-peer software platform called Zoom on Wednesday, September 16, 2020 at 7:00 p.m. Chairman Pietrowski called the meeting to order and the Clerk called the roll. Those Commissioners virtually present were Ms. Suzanne Willis, Mr. Tim Bagby, Mr. Scott Campbell, Ms. Rukisha Crawford, Mrs. Karen Cribben, Mrs. Laurie Emmer, Mr. Steve Faivre, Vice-Chairman John Frieders, Mr. Tracy Jones, Ms. Dianne Leifheit, Ms. Maureen Little, Mr. Jim Luebke, Ms. Terri Mann-Lamb, Mr. Chris Porterfield, Mr. Craig Roman, Ms. Linda Slabon, Mr. Paul Stoddard, Mr. Larry West, Mr. Jeff Whelan, and Chairman Mark Pietrowski. Mr. Tim Hughes, Ms. Kiara Jones, Mr. Jerry Osland, and Mr. Roy Plote were absent at the time of roll call. A quorum was established with twenty Members present and four absent.

Chairman Pietrowski asked Ms. Willis to lead in the reciting of the Pledge of Allegiance.

Mr. Tim Hughes and Mr. Roy Plote arrived. There were now twenty-two Members virtually present.

APPROVAL OF AGENDA

Motion

It was moved by Mr. Porterfield and seconded by Mr. Luebke to approve the agenda as presented.

Amendment #1

Ms. Leifheit moved to remove Resolution R2020-58 (Authorizing a Contribution to the DeKalb County Economic Development Corporation for their Branding Initiative, “Unbound Opportunities”.) from the agenda and send it back to the Finance Committee for consideration during the first quarter of 2021. Mr. Whelan seconded the motion.

Roll Call on Amendment #1

The Chair called for a roll call vote on the amendment. Those Members voting yea were Ms. Willis, Mr. Bagby, Ms. Crawford, Mrs. Cribben, Mrs. Emmer, Mr. Faivre, Vice-Chair Frieders, Mr. Hughes, Mr. Jones, Ms. Leifheit, Ms. Little, Mr. Luebke, Ms. Mann-Lamb, Mr. Plote, Mr. Porterfield, Mr. Roman, Ms. Slabon, Mr. Stoddard, Mr. West, Mr. Whelan, and Chairman Pietrowski. Mr. Campbell was opposed. The motion carried.

Amendment #2

Mr. Roman moved to ungroup and have the Board vote separately on Ordinances O2020-23, O2020-24, and O2020-33 under the Planning & Zoning Committee. Mrs. Emmer seconded the motion.

Chairman Pietrowski called for a roll call on the amendment. Those Members voting yea were Ms. Willis, Mr. Bagby, Mr. Campbell. Ms. Crawford, Mrs. Cribben, Mrs. Emmer, Mr. Faivre, Vice-Chair Frieders, Mr. Hughes, Mr. Jones, Ms. Leifheit, Ms. Little Mr. Luebke, Ms. Mann- Lamb, Mr. Plote, Mr. Porterfield, Mr. Roman, Ms. Slabon, Mr. Stoddard, Mr. West, Mr. Whelan, and Chairman Pietrowski. All Members present voted yea. Motion carried unanimously.

APPROVAL OF MINUTES

Motion

Mr. Whelan moved to approve the minutes of the August 19, 2020 County Board Meeting. Ms. Mann-Lamb seconded the motion.

Chairman Pietrowski asked for a roll call vote on the approval of the minutes. Those Members voting yea were Ms. Willis, Mr. Bagby, Mr. Campbell. Ms. Kiara Jones arrived. There were now twenty-three Members virtually present.

COMMUNICATIONS AND PROCLAMATIONS

Chairman Pietrowski announced that this Saturday and Sunday (September 19-20) the Illinois Department of Public Health is hosting a mobile COVID-19 testing site at the DeKalb County Health Department from 9:00AM-5:00PM both days. The County Health Department is located at 2550 N Annie Glidden Road in DeKalb. This is a state-sponsored mobile testing site that is free and open to all, regardless of symptoms.

Employee Service Awards for September 2020

Chairman Pietrowski recognized the following County Employees who were celebrating Service Awards in the month of September 2020: Five Years: Timothy Brann – Sheriff’s Office, Pamela Patrick – Rehab & Nursing Center, Dytania Washington – Health Department, David Miller – Forest Preserve District; Ten Years: Jill Riipi – Circuit Clerk’s Office.

Ordinance O2020-15: An Ordinance Granting a Use Variation for a Single-Family Home on a Vacant Parcel Located on the East Side of West County Line Road in Franklin Township Motion

Mr. Faivre moved that the DeKalb County Board hereby approves to grant a Use Variation to allow for the construction of one single-family home on a vacant five-acre parcel located on the east side of West County Line Road, approximately 1,000 feet south of McNeal Road, in Franklin Township, with said property having been legally recorded and existing prior to October 29, 1976, being zoned A-1, Agricultural District. Mr. Roman seconded the motion.

Ordinance O2020-16: An Ordinance Amending a Special Use Permit Granted by Ordinance 1975- 09 for the Milan Township Office and Garage Located at 14989 Shabbona Road in Milan Township

Motion

Mr. Faivre moved the DeKalb County Board hereby approves an Amendment to Ordinance 1975-09, to allow for the expansion of the Township property and for the construction of two new structures: a sand & salt storage building, and a pole barn for equipment storage (to be installed at a future time), with conditions as outlined in the Ordinance, located at 14989 Shabbona Road, on the southwest corner of Shabbona and Perry Roads, in Milan Township. Mr. Plote seconded the motion as presented.

Special Use Permits for Solar Gardens

Motion

Mr. Faivre moved that the DeKalb County Board does hereby approve the following Special Use Permits for Solar Gardens in various Townships within the County of DeKalb as detailed in Ordinances O2020-17 through O2020-37, excluding Ordinances O2020-23, O2020-24, and O2020-34. Mr. Stoddard seconded the motion as presented.

Ordinance O2020-17: Approval of a Special Use Permit for a Solar Garden for Property Located on Elva Road, in Milan Township. The DeKalb County Board hereby approves a Special Use Permit (MI-20-05), with conditions as outlined in the Ordinance, requested by Borrego Solar for the construction and operation of a 2-megawatt, 13.7-acre Solar Garden on property on Elva Road, approximately 754 feet west of Anderland Road, in Milan Township (P.I.N.: 10-12-400-005).

Ordinance O2020-18: Approval of a Special Use Permit for a Solar Garden for Property Located on the Northeast Corner of State Route 72 and Pleasant Hill Road, in Kingston Township. The DeKalb County Board hereby approves a Special Use Permit (KI-20-06), with conditions as outlined in the Ordinance, requested by Sunvest Solar Inc. for the construction and operation of a 2-megawatt, 11-acre Solar Garden (SV CSG Kingston 1, LLC) on property on the northeast corner of State Route 72 and Pleasant Hill Road, in Kingston Township (P.I.N.: 02-23-400-005).

Mr. Faivre moved to approve the following two (2) Special Use Permits (O2020-23 and O2020- 24) for Solar Gardens for Property Located on the Southwest Corner of Pine Road and Governor Beveridge Highway, in Somonauk Township. Ms. Slabon seconded the motion.

Ordinance O2020-23: Approval of a Special Use Permit for a Solar Garden for Property Located on the Southwest Corner of Pine Road and Governor Beveridge Highway, in Somonauk Township. The DeKalb County Board hereby approves a Special Use Permit (SO-20-11), with conditions as outlined in the Ordinance, requested by Cenergy for the construction and operation of a 2-megawatt, 9.45-acre Solar Garden (PSCS 1) on property located on the southwest corner of Pine Road and Governor Beveridge Highway, in Somonauk Township (P.I.N.: 18-20-200-002).

Ordinance O2020-24: Approval of a Special Use Permit for a Solar Garden for Property Located on the Southwest Corner of Pine Road and Governor Beveridge Highway, in Somonauk Township. The DeKalb County Board hereby approves a Special Use Permit (SO-20-12), with conditions as outlined in the Ordinance, requested by Cenergy for the construction and operation of a 2-megawatt, 9.45-acre Solar Garden (PSCS 2) on property located on the southwest corner of Pine Road and Governor Beveridge Highway, in Somonauk Township, co-located with PSCS 1 (P.I.N.: 18-20-200-002).

Mr. Faivre moved the DeKalb County Board hereby approves a Special Use Permit (SO-20-18), with conditions as specified in the Ordinance, requested by Summit Ridge Energy for the construction and operation of a 2-megawatt, 13.5-acre Solar Garden (Frieders 1) on property located on the southwest corner of Somonauk and Pine Roads, in Somonauk Township (P.I.N.: 18-22-100-005). Mr. Luebke seconded the motion.

COUNTY HIGHWAY COMMITTEE

Resolution R2020-45: Approval of Plank Road Improvement Study

Motion

Mr. Plote moved that the DeKalb County Board does hereby to enter into an agreement with the Engineering Firm of Crawford, Murphy & Tilly Inc. of Aurora, Illinois for certain engineering services associated with the Plank Road realignment from west of Lindgren Road to east of Lukens Road for an estimated cost not to exceed $141,755.17; and further authorizes and directs the Chairman of the Board to execute the appropriate Preliminary Engineering Services Agreement with Crawford, Murphy & Tilly Inc. Mrs. Emmer seconded the motion as presented.

Mr. Bagby moved the DeKalb County Board hereby authorizes the Chairman of the Board to execute deeds of conveyance of the County’s interest or authorize cancellation of the appropriate Certificate(s) of Purchase, as the case may be for the following seven (7) Resolutions to be paid to the Treasurer of DeKalb County Illinois, to be disbursed according to law. Resolution R2020-57: Placing the FY 2021 Budget on File for Public Inspection

Mr. Bagby moved the DeKalb County Board hereby approves to place on file in the DeKalb County Clerk’s Office, on the County’s Website, and at two other geographically diverse public offices (the Sandwich City Hall and the office of the Genoa City Clerk), for public inspection the fifteen page Budget Narrative Summary Packet (plus Attachments A-D), as well as copies of all information utilized by the Committees in preparation of the 2021 Fiscal Year Budget. Mr. Osland seconded the motion.

Mr. Bagby moved to approve the payment of claims for this month, and the off-cycle claims paid during the previous month, including all claims for travel, meals, and lodging, in the amount of $7,614,845.54. Ms. Slabon seconded the motion.

Resolution R2020-59: A Resolution Approving a Letter of Intent to Enter into a Solar Development Lease

Motion

Vice-Chairman Frieders moved the DeKalb County Board hereby authorizes and directs the County Administrator of DeKalb County, Illinois to sign the Letter of Intent including any modifications of the Letter of Intent subject to technical or otherwise non-substantive modifications, with Clean Energy Design Group Inc. to enter into a long-term lease to provide a solar development on property owned by the County of DeKalb, located at 2500 North Annie Glidden Road, DeKalb, Illinois. Mr. Whelan seconded the motion.

OLD BUSINESS / NEW BUSINESS

Chairman Pietrowski mentioned that although they removed the DCEDC Branding Initiative Resolution from the agenda, he wanted to thank the DCEDC and their Board for the many presentations surrounding the initiative and he hoped, as a Board, when they get a better handle on the effects of COVID-19 that the County will be able to contribute in some way.
