Village of Hinckley Planning Commission Met Oct. 19.

CALL TO ORDER: The meeting was called to order by Chairman Kula at 7:00 PM.
Present: Chairman Russ Kula, Rodney Davis, Steven Krietzer, and Danielle Marion.
Quorum Established.
Absent: Gerald Bahl and John McFarland.
Also Present: Village Clerk Elizabeth Losiniecki, Attorney Conklin, Trustee Mike Constant, and members of the public.
PLEDGE OF ALLEGIANCE: The pledge to the flag was recited.
PUBLIC COMMENT:
None.
AGENDA ITEM: Previous Meeting Minutes – 09/21/20 Presentation and Vote
Steven Kreitzer moved to approve the meeting minutes from 09/21/20 and Danielle Marion seconded the motion. Roll call vote: Davis-Aye, Krietzer-Abstain, Marion-Aye, Kula-Aye. Motion carried.
OLD BUSINESS
° Agenda item for discussion: Cannabis Legalization Survey
There was a discussion about the survey. Chairman Kula stated that the questions in the meeting packet were from him, not Sugar Grove. All agreed to submit the following questions to the Board of Trustees for approval for the survey:
- Do you support or oppose adult recreational cannabis dispensaries in the Village of Hinckley?
- Do you support or oppose medical cannabis dispensaries in the Village of Hinckley?
There will be five responses to check: strongly oppose, somewhat oppose, no opinion, somewhat support, and strongly support along with an option to comment.
The Planning Commission would like the survey to be inserted into the next utility bill. Attorney Conklin stated that there have not been any changes to State regulations. Trustee Constant will present the survey questions to the Board of Trustees at the next Committee of the Whole meeting.
° Agenda item for discussion and Recommendation: Discussion and Recommendation regarding the permitting of Chickens within the corporate limits
Trustee Constant stated that this was on the last Committee of the Whole meeting agenda for discussion but that there was no input from the Village President because she did not attend the meeting. He stated that 3 of 4 Trustees agreed to have the Planning Commission pursue an ordinance for the permitting of chickens. The Planning Commission discussed and agreed to submit the following guidelines to the attorneys for inclusion in the draft ordinance:
- Maximum allowed (8)
- Coop size 2.5 square feet per bird
- No roosters
- Rodent proof food containers
- Predator proof pen (hardware cloth)
- No slaughtering
- Rear yard only
- 5’ from all property lines
- No registration fees
Resident Nate Lamaster suggested that the Planning Commission look at what DeKalb County allows. There was a question about how the ordinance would be enforced and Losiniecki stated that enforcement would be by way of B&F Construction Code Services or the police department. Attorney Conklin stated that if there is non-compliance, a fine would be imposed and then, possibly, a court injunction would be filed. Losiniecki stated that she would provide a bullet point list to the Attorneys and Planning
Commission members (for review and purposes of drafting the ordinance) based on the discussion.

Chairman Kula stated that the next meeting will be November 2, 2020 at 7:00pm via Teleconference and/or at the Village Hall.
