The Regular Meeting of the Shabbona Village Board was called to order by Village President Donald J. Goncher on Monday, June 24, 2019 at 7:00 P.M. in the meeting room of the Village Maintenance building. The following were in attendance:

OPENING OF MEETING/PLEDGE OF ALLEGIANCE/ ROLL CALL

A. ZONING BOARD OF APPEALS AND PLANNING COMMISSION 

1. 2019-06-24(A): AN ORDINANCE ANNEXING 602 E. COMANCHE AVENUE TO THE VILLAGE OF SHABBONA

Frank Ottengheime motioned to approve 2019-06-24(A) An Ordinance Annexing 602 E. Comanche Avenue to the Village of Shabbona, Jamie Deutsch seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

2. 2019-06-24(B): AN ORDANANCE REZONING 602 E. COMANCHE AVENUE TO THE VILLAGE OF SHABBONA

Jamie Deutsch motioned to approve 2019-06-24(B) An Ordinance Rezoning 602 E. Comanche Avenue to the Village of Shabbona, Marc Cinnamon seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins- absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

3. ZONING VARIANCES: RECOMMENDATIONS FROM ZONING BOARD

-203 N. PONTIAC – Front Porch

The Zoning Board of Appeals/Planning commission recommends zoning variance for 203 N. Pontiac Street to the Village Board of Trustees. Jamie Deutsch motioned to approve zoning variance for front porch at 203 N. Pontiac Street, Marc Cinnamon seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins- absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

Frank Ottengheime asked about other residence. Jen Morrison said that hearing was suspended until Wednesday, June 26, 2019, due to request from Zoning Board for resident to provide existing garage footage and drawing with roof lines.

B. VILLAGE ENGINEER—NORM BEEH

Norm’s Project Status report read by Don Goncher. There is a new resident at 310 N. Illini Street, Cindy Barnes will provide contact information to Don Goncher for water looping easement.

Jen Morrison said that the Street Light proposal was sent to driver’s insurance company, they issued the Village a check for amount of proposal. If there is unforeseen expenses during installation of new street light, then we will submit additional billing to the insurance company.

Lift Station: high flow pump went out a couple of weeks ago, Richard Lockowitz asked about proposal for repair versus replace. Buddy Forrer said that vendor is preparing a proposal for both options.

C. MAINTENANCE REPORT—BUDDY FORRER

Annual CCR report was delivered to all residents by Buddy and Trevor. Report is also posted on the Village website and printed copies available at Village Office. Worked on West Cherokee on Thursday, dug out back catch basin and jetted out into field about 180’ and water went down from that catch basin back, still have clean up to do in catch basin. Resident said it helped, Jamie Deutsch agreed it helped. Jamie Deutsch requested further west be cleaned out also. Buddy said field sediment is running down. Engineering may be required to look into anything further. NW to SE 4” tile runs under subdivision 8” into 4” storm lines. Jamie Deutsch asked about alleviating draining to field and connect storm basins together along edge of field line—Buddy said they are tied together already, goes down to houses across from high school. Buddy will find out if Mullins’ have any tile maps, as it is possibly a tiling issue more than storm issue.

Buddy and Trevor took pesticide tests and are certified for weed spraying. They started spraying last Friday. North Indian Road: Buddy talked to Gene Larson and Gene said that truck cannot go all the way up Indian Road and turn around, Township’s company will not spray North Indian Road and Gene talked to resident. Frank Ottengheime said he has number for another company and he will give information to Buddy to call and get estimate.

Challand Road—Don Goncher talked to NextEra. Road has been graded but needs gravel. NextEra asked for estimate for gravel. Don will get gravel estimate for NextEra.

MOWING PROPOSAL: Jamie Deutsch said we would probably not find someone to mow for reasonable price and that hiring a seasonal part time public works employee would be a more cost effective option. Board discussed having a set schedule for summer months and on as needed basis in winter. Buddy is gone Thursday-Friday this week and it is hard to take time off with workload to do. A part time seasonal employee would be helpful to cover vacations and with workload. Clerk Jen Morrison will update the job description and the help wanted ad to read 20 hours/week for Seasonal Summer part time employee at $13/hour for 20 hours per week during Summer months, rest of months will be as needed schedule (winter snow plowing mostly). Frank Ottengheime motioned to pay Buddy Forrer straight time wage for lost vacation time for last year, Richard Lockowitz seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins- absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

D. SHABBONA PATHWAY COMMITTEE-Marc Cinnamon

Jim Johnson working on drafting letters to landowners. Jim Johnson and Dan Nolan attended school board meeting to discuss intergovernmental agreement. Pathway will have a booth at 4th of July Festival. Next meeting is Saturday, July 13, 8am in the Village Office.

E. RPC REPORT-no report, Dan Nolan was unable to attend last RPC meeting.

F. AD-HOC COMMITTEE FOR TREES—MARC CINNAMON

Annual Tree Ceremony was held on May 30th at Indian Creek Elementary School. Three inches of rain that morning so tree planting had to be postponed due to weather. Marc Cinnamon talked to student body about Arbor Day and thanked all the Indian Creek School District staff and administration. Trees were planted 3 days later. Minor maintenance and pruning has been done and they will be mulching within the next month. DeKalb County Forest Preserve donated 12 water bags. Rt 30 welcome sign landscapes have been weeded and trimmed and the sign lighting was adjusted. New labeling on tree city USA signs—4th consecutive year. Planters all weeded, deadheaded, and watering has not been a problem with all the rain. Flowers were planted around memorial monument and shrubs trimmed and shaped. Tree Committee will make tree pruning plants for Fall. Tuck pointing on memorial monument needed, Marc will contact someone. Next tree meeting Saturday, July 20th.

Frank Ottengheime motioned to approve the 5/20/19 Special Meeting minutes, Jamie Deutsch seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

Josh Clark motioned to approve the 5/20/19 Public Hearing minutes, Marc Cinnamon seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime- aye, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

Richard Lockowitz motioned to approve the 5/20/19 Regular Board meeting minutes, Jamie Deutsch seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

2.DEPUTY CLERK—There were 2 applicants, Cindy and Jen interviewed both applicants. Discussion tabled until Executive Session.

FINANCIALS

A. TREASURER’S REPORT

Frank Ottengheime motioned to accept the Treasurer’s report, Josh Clark seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

D. UTILITY BILL ISSUES

Meters are being read this week. Resident on Cherokee Street has family member living in unit above garage rent-free. Ordinance states any unit used for living requires separate water meter. Property owner is paying for one unit worth of usage and should be paying for two units; Cindy Barnes will follow up with property owner. New owner of 201 E. Comanche Avenue is aware of requirement for second water meter and looking into it. Cindy Barnes has not received any response from Matt Lyons to date.

E. APPROVAL OF BILLS

Frank Ottengheime motioned to approve the bills, Marc Cinnamon seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

F. FY 19/20 APPROPRIATIONS

Frank Ottengheime motioned to approve Ordinance 2019-06-24(C) Annual Appropriation Ordinance for the Village of Shabbona for the Fiscal Year 2019-2020, Richard Lockowitz seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

G. ANNUAL TREASURER’S REPORT—FIRST READING

Cindy will amend the report—Brimfield should be Brimfield Bank. Final Read will be at July meeting. Proposed West Navaho water, sewer and storm project: Clarification was provided by Cindy Barnes that the costs for the storm portion cannot come out of Sanitary Sewer funds. It must come out of general account.

OLD BUSINESS

A. ECONOMIC DEVELOPMENT

1. Shabbona Marketing Brochure is currently at BP, Casey’s, D&H, Emerald Butterfly, Clint Sands (Pokanokas/Camp Store), Library, Chumley’s, and the Village Office. Janet still needs to drop brochures off at R&R Pub, SLR Museum, State Park Campground. I39 form was filled out and Janet is waiting for approval to stock village brochures at rest stop(s).

NEW BUSINESS

A. PRAIRIE BAND POTAWATOMI NATION SUPPORT LETTER

Three letters are prepared to go out to the Adam Kinzinger, Dick Durbin, and Tammy Duckworth. PBPN would like to get congress to enact settlement on the property they have purchased and clear title of remaining land. There has been a bill introduced at federal level, to finalize the land they purchased and clear the titles of the other land. Frank Ottengheime motioned to send letters to Illinois US Representative and Illinois US Senators, Marc Cinnamon seconded. All in favor-aye. Motion carried.

B. COMMITTEES

Currently by ordinance, in order to establish standing committees the Board of Trustees must approve establishment of committees. Don Goncher proposed that each trustee serves on two committees and each committee meets quarterly on an as needed basis. Jamie Deutsch, Frank Ottengheime, and Richard Lockowitz do not think committees are needed. Marc Cinnamon said he likes the structure and planning that can happen with having committees. Discussion tabled until next meeting.

C. SPEED LIMIT ON WEST PRESERVE ROAD

Frank Ottengheime expressed concern about speeding on Preserve Road. The speed limit signs are 35mph but Frank said vehicles are consistently traveling way over that. Don Goncher said that the Sheriff’s Department enforces speed limit. Cindy Barnes asked if North Shabbona Road could be enforced also. Don Goncher will contact Sheriff.

D. WEIGHT LIMIT ON VILLAGE STREETS

Navaho/Illini to Hwy 30—When trains are blocking crossings some semis are detouring onto Village streets which have a 5 ton limit. Frank Ottengheime wants weight limit signs posted and weight limit on Village streets enforced. Buddy will verify that signs are posted on Navaho and North Illini. Don Goncher will request Sheriff enforces Village Street weight limit.

E. LAND TRADE WITH SHABBONA FIRE DISTRICT

Frank Ottengheime said that the Shabbona Fire District would like to purchase a strip of the Village owned property located at the SE corner of Illini and Navaho. The lot is 95’ wide (West to East) and the SFD would like 30’ of this lot along the east lot line for $1.00. SFD would swap the lot that they are supposed to be receiving from Doc Purdy on the corner of Pontiac and

Navaho (50’ wide). Frank stated the Village has two lots at Illini and Navaho and that the 30’ strip was a second lot that had been split off years ago when the fire department building was built. Frank requested Well House #6 be moved over so it wouldn’t be on 30’ SFD wants. Don Goncher raised the concern that we cannot just move the well house over as it has been approved by IL EPA as part of the loan procedure and new plans would have to be submitted to IL EPA and it may result in issues with IL EPA loan process that we are almost complete with. Don Goncher asked why none of the Shabbona Fire District board trustees were not present to make this request from the Village and asked if Frank was representing the Shabbona Fire District board at their request. Frank Ottengheime said he was representing SFD board with their permission. Don asked if Fire Department members should vote on this matter and Keith Foster said that it is more a recommendation that they do not vote but they can vote.

Frank motioned that the Village of Shabbona sell the 30’ lot at Illini/Navaho Streets to the Shabbona Fire District for $1 with the exemption that if ILEPA loan would be declined due to well house relocation and to sell the 50’ lot at Pontiac/Navaho Streets that the Shabbona Fire Department is to receive from Doc Purdy to the Village of Shabbona for $1. Jamie Deutsch seconded the motion. Roll Call Vote: Marc Cinnamon-no, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-absent, Josh Clark-no, Richard Lockowitz-aye. 3 aye, 2 no, 1 absent. Motion carried.

F. WATER PROBLEM ON WEST CHEROKEE—Already covered under maintenance.

G. LOUD MOTORCYCLES

Frank Ottengheime said that something needed to be done about noise level of motorcycles. Discussion about motorcyclists traveling around and through town and that nothing can be done unless nuisance. If there is a nuisance issue with loud motorcycles, residents need to call and report to Sheriff.

Jamie Deutsch motioned to go into executive session at 8:47pm, Richard Lockowitz seconded. All in favor vote aye. Motion carried.

Marc Cinnamon motioned to hire Laurie Wilson as Deputy Clerk with caveat of background check, Richard Lockowitz seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-abstain, Joe Perkins-absent, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.
