City of DeKalb City Council met Nov. 12.

The City Council of DeKalb, Illinois held a Regular City Council Meeting on November 12, 2019, in the City Council Chambers of the DeKalb Municipal Building, 200 South Fourth Street, DeKalb, Illinois.

A. CALL TO ORDER AND ROLL CALL

Mayor Smith called the meeting to order at 6 p.m.

City Clerk Lynn Fazekas called the roll, and the following members of City Council were present: Alderman Carolyn Morris, Alderman Bill Finucane, Alderman Tracy Smith, Alderman Scott McAdams, Alderman Mike Verbic, Alderman Tony Faivre, and Mayor Jerry Smith.

Staff present included: City Manager Bill Nicklas, Fire Chief Jeff McMaster, City Attorney John Donahue, Interim Police Chief John Petragallo, and Principal Planner Dan Olson.

B. PLEDGE OF ALLEGIANCE TO THE FLAG OF THE UNITED STATES

In recognition of Veterans Day, the City played the song, “God Bless the USA” while displaying the lyrics on monitors. Mayor Smith then led the Pledge, and he was followed by veteran Mike Embrey, who reported on Veterans Day events across the City.

C. APPROVAL OF THE AGENDA

Mayor Smith asked for additions or deletions. None were offered.

MOTION

Alderman Smith moved to approve the agenda. Alderman Morris seconded.

VOTE

Motion carried 7-0 on roll call vote. 

Aye: Morris, Finucane, Smith, McAdams, Verbic, Faivre, Mayor Smith. 

Nay: none. 

Mayor Smith declared the agenda approved as printed.

D. PUBLIC PARTICIPATION

There was none.

E. PRESENTATIONS

1. DeKalb Fire Department Recognition.

City Manager Nicklas named each DeKalb fire fighter who was involved in the recent water rescue of a person from a vehicle in the Kishwaukee River. Recognized by Council, Fire Chief McMaster, and the audience were: Deputy Fire Chief Bart Gilmore, Battalion Chief Jeff Jossendal, Captain Todd Stoffa, Lieutenant Chris Ziola, Lieutenant Wade Schneck, Lieutenant Tom Conley, Firefighter/Paramedic Steve Cruz, Firefighter/Paramedic Noah Millard, Firefighter/Paramedic Trevor Chilton, Firefighter Sean Freeman, Firefighter/Paramedic Joe Fisher, Firefighter/Paramedic Greg Thornton, Firefighter/Paramedic Robert Terry, Firefighter/Paramedic Joe Wempe, and Firefighter/Paramedic Joe Long.

F. APPOINTMENTS

1. Appointment of Gregory J. Perkins as Fourth Ward Alderman until His Successor Qualifies and Takes Office.

MOTION

Alderman Finucane moved to approve the appointment. Alderman McAdams seconded.

VOTE

Motion carried 7-0 on roll call vote. 

Aye: Finucane, Smith, McAdams, Verbic, Faivre, Morris, Mayor Smith. 

Nay: none. 

Mayor Smith declared the appointment approved.

City Clerk Fazekas administered the oath of office to Mr. Perkins as his family looked on. Alderman Perkins then took his seat on the dais.

2. Appointment of India Washington to the DeKalb Public Library Board for the Completion of a Term through June 30, 2021.

MOTION

Alderman Smith moved to approve the appointment. Alderman Verbic seconded. 

VOTE

Motion carried 8-0 on roll call vote. 

Aye: Smith, Perkins, McAdams, Verbic, Faivre, Morris, Finucane, Mayor Smith. 

Nay: none. 

Mayor Smith declared the appointment approved.

G.

CONSENT AGENDA

1. Minutes of the Joint Review Board Meeting of July 26, 2019.

2. Minutes of the Committee of the Whole Meeting of October 28, 2019.

3. Minutes of the Regular City Council Meeting of October 28, 2019.

4. Accounts Payable and Payroll through November 12, 2019, in the Amount of $1,554,409.87.

5. Fire and Police Pension Fund Municipal Compliance Reports for the Fiscal Year Ending December 31, 2018.

Mayor Smith read each item of the consent agenda. He then asked if any Council member wanted to remove an item for separate action. No requests for removal were made.

Alderman Morris moved to approve the consent agenda. Alderman Verbic seconded.

Motion carried 8-0 on roll call vote.

J. RESOLUTIONS

1. Resolution 2019-148 Establishing an Estimated Annual Tax Levy Ceiling for the Tax Year 2019.

Alderman Verbic moved to approve the resolution. Alderman Faivre seconded.

City Manager Nicklas reminded Council that debt service and Special Service Area (SSA) levy amounts shown will be abated.

Motion carried 8-0 on roll call vote.

Nay: none. 

Mayor Smith declared the resolution approved.

2. Resolution 2019-149 Authorizing the Sale of Real Property Located at 402 Gurler Street (P.I.N. 08-23-403-002) in the Amount of $7,000.

Alderman Smith moved to approve the resolution. Alderman Faivre seconded.

VOTE

Motion carried 8-0 on roll call vote.

3. Resolution 2019-150 Authorizing the Sale of Real Property Located at 1015- 1017 Market Street (P.I.N. 08-23-256-011) in the Amount of $10,500.

4. Resolution 2019-151 Approving a Real Estate Contract for the Sale of Real Property Located at 1101 N. First Street (P.I.N. 08-14-305-018) and the Closing of the Transaction.

K. ORDINANCES – SECOND READING

1. Ordinance 2019-069 Amending Chapter 23, “Unified Development Ordinance,” Article 5, “Zoning District Regulations,” and Article 7, “Supplementary District Regulations,” of the City of DeKalb, Illinois Municipal Code as it Pertains to Adult Use Cannabis.

Mayor Smith read the ordinance by title only.

Alderman Finucane moved to approve the ordinance. Alderman Faivre seconded.

Motion carried 8-0 on roll call vote.

L. ORDINANCES – FIRST READING

1. Ordinance 2019-071 Amending Chapter 38 “Intoxicating Liquors,” Section 38.18(a) “Caterer Event Permits.”

Mayor Smith read the ordinance by title only. 

MOTION

Alderman Verbic moved to pass first reading. Alderman McAdams seconded.

City Manager Nicklas confirmed for Council members that the fee covers administrative costs and applies to events of all sizes, and that a permit no longer has to be obtained separately for each event.

Motion carried 8-0 on roll call vote. 

Aye: Smith, Perkins, McAdams, Verbic, Faivre, Morris, Finucane, Mayor Smith. 

Nay: none. 

Mayor Smith declared passage of first reading.

2. Ordinance 2019-072 Amending Chapter 38 “Intoxicating Liquors”, Section 38.27(c)8 “Gambling Devices”, by Revising the Number of Liquor Licenses for Establishments that Qualify as Video Gaming Establishments to Include the Property Located at 1208 E. Lincoln Highway.

Mayor Smith read the ordinance by title only.

Alderman Finucane moved to pass first reading. Alderman McAdams seconded.

VOTE

Motion carried 8-0 on roll call vote.

Alderman Finucane moved to waive second reading and approve the ordinance. Alderman McAdams seconded.

Mayor Smith declared the ordinance approved.

3. Ordinance 2019-073 Authorizing the Implementation of Impact Fee Waivers for New Construction Permits for Attached Single Family Townhomes in the Wineberry, South Pointe Greens, and River Mist Subdivisions.

Mayor Smith read the ordinance by title only. The mayor also noted the ordinance should specify “Gardens of River Mist.”

Alderman Smith moved to pass first reading. Alderman Verbic seconded.

VOTE

Motion carried 8-0 on roll call vote.

Alderman Verbic moved to waive second reading and approve the ordinance. Alderman Smith seconded.

M. REPORTS AND COMMUNICATIONS

1. Council Member Reports

Alderman Morris said she would like to take action on the community survey that was suggested during Council’s planning meeting last summer.

Alderman Finucane announced the upcoming IHSA tourney and the Salvation Army’s “Let’s Talk Turkey” charitable event.

Alderman Smith said he would like to see more 15-minute parking spots downtown, beginning with the southeast corner of Second and Locust Streets.

Alderman Faivre welcomed Alderman Perkins to Council.

Mayor Smith reported on a peaceful demonstration of more than 100 people that he attended during the previous weekend.

2. City Clerk Report

Clerk Fazekas gave no report. 3. City Manager Report

City Manager Nicklas responded to Alderman Smith’s and Alderman Morris’ requests as described above. He said he will take up the parking request as soon as possible, and offered to have a framework for the community survey prepared for the second meeting in January.

N. EXECUTIVE SESSION PURSUANT TO 5 ILCS (120/2)

1. Approval to Hold an Executive Session in Order to Discussion the Purchase or Lease of Real Property as Provided for in 5 ILCS 120/2(C)(5).

Mayor Smith read the session item.

Alderman Smith moved to recess for executive session. Alderman Perkins seconded.

VOTE

Motion carried 8-0 on roll call vote.

Mayor Smith declared a recess at 6:55 p.m.

O. ADJOURNMENT

Following adjournment of the executive session, Alderman Finucane moved to adjourn the regular meeting. Alderman Faivre seconded.

VOTE

Motion carried by majority voice vote. Mayor Smith declared the regular meeting adjourned at 7:11 p.m.
