The Regular Meeting of the Shabbona Village Board was called to order by Village President Donald J. Goncher on Monday, June 22, 2020 at 7:00 P.M. in the video conference room https://us02web.zoom.us/j/85215532415?pwd=L3VLUkx1a3BpRGw5Z21ZYXFmUkpldz09.

OPENING OF MEETING/MEETING GUIDELINES/ ROLL CALL: Pursuant to OMA Remote Meeting Legislation PA100-0640(SB2135) signed by Governor Pritzker on June 12, 2020, all votes must be roll call during a remote meeting-from the opening of meeting and including adjournment. An officer must be present during the meeting at the regular meeting room, Marc Cinnamon is present in the regular meeting room. This meeting is being recorded. APPROVAL OF AGENDA – Frank Ottengheime motioned to approve the agenda, Richard Lockowitz seconded. Roll Call Vote: Frank Ottengheime-aye, Marc Cinnamon-aye, Jamie Deutsch-aye, David Simpson-aye, Richard Lockowitz-aye, Josh Clark-aye. 6-0 Motion carried.

REPORTS and ACTION

A. ELECTRICAL AGGREGATION ANNUAL RENEWAL

Arnie Schramel presented to board about annual electrical aggregation renewal, electric suppliers are agreeing to guarantee a lower price than ComEd for one year at a time. 6.4-6.5% range is anticipated, and Village President will need to sign contract by July 12, 2020. ComEd will be over 7%. Arnie recommends proceeding forward with aggregation authorization for the Village President to sign contract by July 12. Marc Cinnamon motioned to approve signing Ordinance 2020-06-22(B) Authorizing Aggregation of Electrical Load, David Simpson seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Josh Clark-aye, Richard Lockowitz-aye, David Simpson-aye, Frank Ottengheime-aye. 6-0 Motion carried.

B. COVID 19 UPDATE

Don Goncher updated on COVID-19: The Shabbona Firework display cancelled. The organizers of the CEA never requested a parade resolution as required by IDOT so the parade cannot happen this year and the 4th of July festival was cancelled. The Farmer & Artisan Market by Destination Shabbona group has been successful. June 26, 2020, begins Covid-19 Illinois Phase Four. The opening of Water Tower Park has been long awaited by the children and parents. Public Works is forging ahead with new equipment installation including a new drinking fountain and doing playground maintenance at the park. Don asks everyone to please remember social distancing and the wearing of masks.

GAMING MACHINE PARTITIONS - Richard Lockowitz said that R&R Pub has asked if the Village would help with the cost of COVID-19 regulated partitions for gaming machines and proration of liquor license for 3 months since liquor sales were impacted. He said since village gets revenue off gaming machines, he is asking if village board will help R&R out. Frank Ottengheime recommended no more than $500 for gaming machine partitions. Don Goncher asked about BP as they also having gaming machines. Frank Ottengheime motioned for gaming machine partition reimbursement up to $500 maximum and R&R Pub and BP must provide receipts to receive reimbursement, Richard Lockowitz seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Josh Clark-aye, Richard Lockowitz-aye, David Simpson-no, Frank Ottengheime-aye. 5-1 Motion carried.

LIQUOR LICENSE PRORATION - Discussion of liquor license proration for 3 months, Don Goncher said that board also needs to consider Indian Oaks Country Club as they had similar COVID-19 liquor sales impact as R&R Pub. Josh Clark motioned to prorate liquor license costs for 3 months for R&R Pub and Indian Oaks Country Club and to reimburse both the amount of $300, Richard Lockowitz seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Josh Clark-aye, Richard Lockowitz-aye, David Simpson-no, Frank Ottengheime-aye. 5-1 Motion carried.

Attorney Keith Foster said that remote meeting option for public meetings is set to expire 6/25/2020. If the governor does not renew emergency disaster proclamation, we will need to meet in person next month.

C. VILLAGE ENGINEER-NORM BEEH

Marc Cinnamon updated on streets, sidewalks, and ADA accessibility/curbing are 3 separate projects. Eric Petersen Construction is unable to do the job at this time. Norm has a couple of contractors coming to look at what is needing to be done and he should have pricing from them within a week. Norm has K&L Services lined up for streets, they will do the work and Village will provide all materials. Bids for sealcoating Preserve and for Martenson subdivision streets, Cherokee to Blackhawk, Navaho from N Shabbona to Illini will go out with next DeKalb County Highway letting. $130,000 estimate and appropriation should be $140,000 for streets. Marc Cinnamon recommends moving forward with this. Norm should have letting results at July meeting. Marc motioned to move ahead with sealcoating provided bid comes in below $140,000 and amend appropriations to $140,000 for street projects, Josh Clark seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Josh Clark-aye, Richard Lockowitz-aye, David Simpson-aye, Frank Ottengheime-aye. 6-0 Motion carried.

D. MAINTENANCE REPORT-BUD FORRER

Clean up week 6/15-19: filled 6 dumpsters, every day except Friday dumpster was filled by 11am, Friday first dumpster filled at 9am and second dropped and filled by 3pm due to a number of residents putting out a lot of stuff Thursday night. They took a lot of scrap metal to UCC. Drinking fountain at Water Tower Park was installed and will be turned on when park opens. Working on groundwork for new climber and need to get stump ground out of area before installation of climber. May need additional playground mulch. Pressure washing and sanitizing playground equipment prior to opening. Watering flowers Tuesdays & Fridays. Reading water meters next week.

E. SHABBONA PATHWAY COMMITTEE—MARC CINNAMON

Had meeting in June, first meeting in 3 months. Moving slowly forward with pathway, work will be starting in next month or so for portion near the schools. Planned progress was delayed due to COVID-19.

F. SHABBONA HORTICULTURAL COMMITTEE—MARC CINNAMON

Watering routine twice a week is good. During a storm earlier in the month, a tree came down at 115 E. Apache and previous owner requested reimbursement for tree removal as tree turned out to be in village right of way. Marc Cinnamon verified what was in the village right of way and he recommends the board reimburse for removal. They also pruned and trimmed trees that were on garage roof and these are also trees in the right of way. 15-16 trees that are all on village right of way, majority of them are in good health. Marc Cinnamon motioned to reimburse Joan Chavario $1200 for 115 E. Apache tree removal and trimming, Josh Clark seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Josh Clark-aye, Richard Lockowitz-aye, David Simpson-aye, Frank Ottengheime-aye. 6-0 Motion carried.

G. SHERIFF REPORT - Reviewed Sheriff’s report.

H. CLERK & DEPUTY CLERK

APPROVAL OF MINUTES-Richard Lockowitz motioned to approve the minutes, David Simpson seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Richard Lockowitz-aye, David Simpson-aye, Josh Clark-aye, Frank Ottengheime-aye. 6-0 Motion carried.

Census 2020: still below 2010 response rate of 75%, currently at 72.7%. DeKalb County had reusable grocery cooler bags available and Destination Shabbona group has been handing them out during the Farmers Market on Saturday mornings.

Building Permit spreadsheet: Clerk provided monthly update on permits issued, Clerk sends permits monthly to the Township Assessor as required.

A. APPROVAL OF BILLS – Josh Clark motioned to approve the bills, Marc Cinnamon seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, David Simpson-aye, Josh Clark-aye, Richard Lockowitz-aye. 6-0 Motion carried.

B. TREASURER’S REPORT – Josh Clark motioned to accept the Treasurer’s report, David Simpson seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, David Simpson-aye, Josh Clark-aye, Richard Lockowitz-aye. 6-0 Motion carried.

C. UTILITY ISSUES - none

D. ORDINANCE 2020-06-22(A) ANNUAL APPROPRIATIONS FOR FISCAL YEAR 2020-2021 - Frank Ottengheime motioned to approve Ordinance 2020-06-22(A) Annual Appropriations for Fiscal Year 2020-2021 with amendment of Streets to $140,000, David Simpson seconded. Roll Call Vote: Josh Clark-aye, Jamie Deutsch-aye, Richard Lockowitz-aye, Marc Cinnamon-aye, David Simpson-aye, Frank Ottengheime-aye. 6-0 Motion carried.

E. FY20 ANNUAL TREASURER’S REPORT - Josh Clark motioned to accept FY20 Annual Treasurer’s Report with correction of Lockoich to Lockowitz, David Simpson seconded. Roll Call Vote: Josh Clark-aye, Jamie Deutsch-aye, Richard Lockowitz-aye, Marc Cinnamon-aye, David Simpson-aye, Frank Ottengheime-aye. 6-0 Motion carried.

OLD BUSINESS

A. ILLINI STREET WATER/SEWER/STORM MAINS - Don Goncher asked board to consider motion to do

engineering and be shovel ready for infrastructure programs that are supposed to be coming available this year. $67,000 for engineering, project estimated at $900,000. Josh Clark motioned to approve engineering on Illini Street for water/storm/sewer, Marc Cinnamon seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Josh Clark-aye, Richard Lockowitz-aye, David Simpson-no, Frank Ottengheime-aye. 5-1 Motion carried.

B. TITLE 8 BUILDING ORDINANCE - B&F Construction Codes has provided an edited Title 8 Building Ordinance to update to current codes, all new permits would be issued based on updated codes once Ordinance is approved by board. Attachment also provided includes permit fee schedule and there will be a list of when a permit is not needed coming from Seth at B&F. Josh Clark motioned to approve Attorney Foster update Title 8 Building Ordinance, David Simpson seconded. Roll Call Vote: Josh Clark-aye, Jamie Deutsch-no Marc Cinnamon-aye, David Simpson-aye, Richard Lockowitz-no, Frank Ottengheime-no. 3-3 tie, due to tie vote, Mayor Goncher votes aye to break the tie 4 aye-3 no, Motion carried.

C. EDI INVOICE - EDI told us that we had received final bill and we paid that in April. They did the work, but they incorrectly told us that we had the final bill in April. Invoice is for $20,250.30 and they did not deduct 5 days liquidation damage for not being done on time, $509.93 electrician time and they had wrong phase blowers, $220.56 for time public works superintendent was on hand during wrong phase blower installation. Don Goncher recommended to board that village pay $17,641.78. Don has detailed logs and emails from communication with EDI. Attorney Keith Foster said he agrees with deductions for items mentioned. EDIs internal communication was very poor. David Simpson motioned to pay EDI $17,641.78 as proposed by Village President Goncher, Josh Clark seconded. Roll Call Vote: Richard Lockowitz-no, Jamie Deutsch-aye, David Simpson-aye, Josh Clark-aye, Marc Cinnamon-aye, Frank Ottengheime-no. 4-2 Motion carried.

NEW BUSINESS

A. JOE PERKINS MEMORIAL PARK SIGN LOCATION/INSTALLATION - Location for sign has been staked out and is directly across from Water Tower Park. Frank Ottengheime requested waiting until next month to install the sign as Shabbona Fire District may have something to contribute to the Joe Perkins Memorial Park. Installation timing was tabled until July 27, 2020 meeting.

B. ORDINANCE 7-4-4 PLACEMENT OF RECEPTACLES FOR PICK UP - Don Goncher asked board to consider updating 7-4-4 ordinance as it would help eliminate the receptacles being left on sidewalk all the time along Comanche Ave sidewalk. David Simpson motioned to approve sending Ordinance 7-4-4 Placement of Receptacles for Pick Up to Attorney Keith Foster for amending with sidewalk, Josh Clark seconded. Roll Call Vote: Richard Lockowitz-aye, Jamie Deutsch-aye, David Simpson-aye, Josh Clark-aye, Marc Cinnamon-aye, Frank Ottengheime-aye. 6-0 Motion carried.

C. PONTIAC STREET RAILROAD CROSSING - Frank Ottengheime said that the Pontiac Street railroad crossing is worse than when they repaired it and requested it be addressed by railroad again. Don Goncher will make contact with railroad. It was also brought up that the alley behind north Route 30 is bad from Illini to Nokomis.

D. Frank Ottengheime reported that the village camera overlooking Joe Perkins Memorial Park and Water Tower Park has died. Don Goncher asked where it feeds, Frank said into a recorder in the fire station.
