a. Ordinance O2025-05 — An ordinance approving a Special Use Permit to operate a construction business on property located at 6139 South Malta Road, in DeKalb Township. The subject property is zoned A-1, Agricultural District.
Juan Gamez and Gabriela Quintero are seeking approval to operate their construction business, Gamez Construction Inc., on their property located at 6139 South Malta Road, in DeKalb Township. The subject property is zoned A-1, Agricultural District, and the operation of such a business in the A-1 District requires the approval of a Special Use Permit. The required public hearing for this Special Use Permit was conducted by Hearing Officer Dale Clark on May 6, 2025. Mr. Clark has made his findings of fact and recommended that the Special Use Permit be granted with conditions. (Petition DK-25-06)

a. Consideration and Recommendation of Permit Fees Adjustment
Community Development staff have identified areas of department roles and functions that are becoming increasingly difficult to complete as we have done in the past. Staff is proposing an adjustment to the current Zoning Verification Permit (agricultural exempt structure(s)) fee, increasing it from zero to $150. The reasoning behind this request is that the existing fee structure for these permits do not cover the costs associated with employee salaries and benefits for our department, placing strain on our financial operations and staff availability as they permits are taking far more time today than they did even 5, 15 or 25 years ago. Additionally, each permit requires handling by no fewer than three individuals to ensure proper processing and compliance with local and state regulations which only contributes to the added strain on department staff.
