5. ORDINANCES
a. Ordinance O2025- — An ordinance approving a Special Use Permit for a 4.5-Megawatt Commercial Solar Energy System located at 6236 State Route 38, in DeKalb Township.
TurningPoint Energy, LLC d/b/a TPE Development (TPE) is seeking to establish and operate a 4.5- megawatt commercial solar facility, to be known as TPE IL DE447, LLC, on approximately 25.4-acres of the 48.33-acre former golf course property located at 6236 State Route 38, DeKalb, in DeKalb Township. The property is zoned A-1, Agricultural District. In 2023, DeKalb County Ordinance O2023-021 granted approval to TurningPoint Energy, LLC (TPE) for the establishment and operation of a 4.5-megawatt commercial solar facility, to be known as TPE IL DE447, LLC, on the former golf course property located 6236 State Route 38, in DeKalb Township. The Special Use Permit approved by this ordinance was subject to thirty-three conditions, one of which required that Building Permits be sought within 18 months of the approval date of the Ordinance, otherwise it would expire. TPE still desires to move forward with this project and is seeking approval of a new Special Use Permit for this project. The required public hearing for the Special Use Permit was conducted by Hearing Officer Dale Clark on July 17, 2025. Mr. Clark has made his findings of fact and recommended that the Special Use Permit be granted with conditions. (Petition DK-25-11)
b. Ordinance O2025- — An ordinance approving special use permits to Burr Oak Solar, LLC, for a Solar Farm located on various properties in Afton, Pierce and Squaw Grove Townships.
Burr Oak Solar, LLC, a subsidiary of Leeward Renewable Energy, has submitted applications to establish and operate a three-hundred-megawatt (300mw) CSES that would occupy approximately 1,984-acres of land in Afton, Pierce, and Squaw Grove Townships. The proposed CSES would be spread out over approximately twenty-one separate properties; with the subject properties being located in the area roughly bounded by Perry Road to the north, Crego Road to the west, Lasher Road to the South, and Somonauk Road to the East. (Note: The majority of the properties located within the aforementioned area would not be part of the proposed CSES.) The proposed CSES will be a utility-scale development consisting of the component solar arrays, a project substation, a Commonwealth Edison (ComEd) Switchyard, and an “operations and maintenance” building. The required public hearing for the Map Amendment was conducted by Hearing Officer Dale Clark on July 17, 2025. Mr. Clark has made his findings of fact and recommended that the Special Use Permits be granted with conditions. c. Ordinance O2025- — An ordinance approving an amendment to a Special Use Permit for a concrete business located at 1275 E State Street in Sycamore Township.
Tom and Sam Doty, representing Doty & Sons Concrete Products, are requesting an amendment to their Special Use Permit that would allow for the proposed expansion to their business operation located at 1275 E. State Street, in Sycamore Township, with the construction of an addition onto their existing building. The property is zoned BC, Business Conservation District, with a special use permit for the operation of a concrete business. The required public hearing for the Special Use Permit was conducted by Hearing Officer Dale Clark on July 24, 2025. Mr. Clark has made his findings of fact and recommended that the Special Use Permit Amendment be granted with conditions. (Petition SY-25-20)
d. Ordinance O2025- — An ordinance approving a Special Use Permit for a 5-Megawatt Commercial Solar Energy System located on the southeast corner of State Route 72 and Pleasant Hill Road, in Kingston Township.
SunVest Solar, LLC requests approval for the construction and operation of a Commercial Solar Energy System (CSES), to be known as SV CSG Kingston Solar 1, LLC, on a 43.28-acre property located on the southeast corner of State Route 72 and Pleasant Hill Road, in Kingston Township. The property is zoned A-1, Agricultural District. In 2018, DeKalb County Ordinances 2018-17 and 2018-46 were granted approving the establishment and operation of two (2) separate 2-megawatt CSES’s collocated on the subject in anticipation of being selected to participate in the Illinois Community Solar Program. Ordinances for CSES’s contain, as a condition of approval, the requirement that Permits had to be applied for within eighteen (18) months of the approval date of the Ordinance, otherwise the Ordinance would expire. The petitioners still seek to move forward with this project, due to changes in the State program, this new application will be for just one (1) 5-megawatt CSES instead of two (2) separate 2-megawatt CSES’s collocated on the subject property. The required public hearing for the Special Use Permit was conducted by Hearing Officer Dale Clark on June 24, 2025 and continued to August 14, 2025. Mr. Clark has made his findings of fact and recommended that the Special Use Permit be granted with conditions. (Petition KI-25-21)
