Village of Shabbona Village Board met Oct. 28.

The Regular Meeting of the Shabbona Village Board was called to order by Village President Donald J. Goncher on Monday, October 28, 2019 at 7:00 P.M. in the meeting room of the Village Maintenance building. The following were in attendance:

OPENING OF MEETING/PLEDGE OF ALLEGIANCE/ ROLL CALL

Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-late came in at 7:09pm, Frank Ottengheime-aye, Joe Perkins-aye, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

Joe Perkins motioned to approve the minutes. Marc Cinnamon seconded. All in favor vote aye. Motion carried.

CITIZENS ADDRESSING THE BOARD: Kyle Hart addressed the board, he is trying to get best most productive use of spaces he owns at 206 E. Comanche Avenue and heard about streetscape plan. He is excited about plan and has been thinking about how parking could improve; there are currently 8 spots between café and his building which changes to 4 parking spots on concept plan. He expressed his concern about laundry mat, post office and barbershop parking and wanted to let board know his concerns. Don Goncher let him know we appreciated his concerns and Marc Cinnamon thanked Kyle for everything he is trying to do for the town.

REPORTS and ACTION

A. ANNUAL AUDIT REPORT-JENNIFER MARTINSON, LAUTERBACH & AMEN LLP

Jen Martinson thanked Cindy for all her hard work with audit documents and working partnership with auditors. Village audit report is a clean report. She reviewed Management review and gave brief overview of financial highlights. All funds ended up under budget for expenditures. There are a few best practice policies recommended to be done, Cindy is already doing bank reconciliations. It was a very smooth audit process this year. Board had no questions about audit.

B. VILLAGE ENGINEER-NORM BEEH

Norm attended an EPA seminar last week and EPA is going to have a concerted effort to get lead out of every public water system. As part of this effort, every community will be required to prepare a map that shows distribution and service line materials. Norm said only lead we should have is service lines, Don Goncher asked if these were main lines or residential property lines. Norm said lead lines would be from basement to main line. If a lead line is touched for any reason, lead line will need to either be replaced or resident will need to install a filtration system. West Navaho should be new enough that there aren’t any lead lines. Probably going to be a 10 year program and EPA will possibly assist with funding. Norm said that mapping like what Waterman is doing does not address type of material.

Streetlight at First State Bank has been replaced; light is different but uses a ninth of the power the rest use. Norm recommended the Village should look at updated LED streetlights eventually.

ORDINANCE 2019-09-23(B) IL EPA LOAN AGREEMENT: Petition was received by Village Clerk and it will be filed with DeKalb County Clerk. If 58 of the signatures are valid residents and registered voters, then it will be a question for the voters on March 2020 ballot. If voters say no to this loan, we won’t be eligible for IL EPA low interest loan. The board will then need to decide what to do next. Everything is on hold for next 6 months (well and water looping) if this goes to ballot in March 2020. Norm talked to IL EPA loan application advisor on Friday and everything is in place except for borrowing ordinance and legal opinion regarding it. This was the last piece of the loan application process. Once a year IL EPA reviews projects for whose moving forward and who is not yet, there are 4 groups and we were in 2nd group moving forward and the further down the list we go, less funding is available. Easements are in place at Illini/Hiawatha for water looping connection. West Navaho everything is planned in public right away. Preserve/Shabbona Road there is a mass of utilities in north ditch line because southside belongs to State Park. The best solution would be running under Preserve Road and would need to have Pathway project move ahead and secure 20’ of farm easement in order to run under Preserve Road.

Wastewater Treatment Plant Aeration: EDI has delivered all materials to site and are starting on Wednesday 10/30 and plan to have everything installed by Thursday10/31. Blowers are not in yet, so existing will be used temporarily until new blowers are received and installed. Norm still waiting on commitment date for blowers from EDI, he will continue to push them for date.

Header pipe replacement—Norm pushed EDI for what they needed for distribution points from new header pipe. Initially EDI told him $120,000 for stainless steel header pipe, then EDI gave an alternate of $37,000 for PVC even after Norm told them it should be under $10,000 to do. Core & Main less than $5000 labor and materials, Public Works staff was able to do a lot of the work. We would have had to use our staff with EDI as well. We did not have to remove old pipe, it will be capped off when switch over happens. Header pipe was installed to EDI specifications and they will tie aeration to it. One existing blower is not working, the other blower will be stored for back up. Frank Ottengheime asked if there was there a written specification provided, Norm said no but he told EDI cost should be under $10,000 from the start. We asked for specifications from EDI, Core & Main priced from those specifications. Frank Ottengheime questioned about bid process for header replacement. Joe Perkins said that this was not in bid for aeration, it was after contract signed with EDI, and we don’t need bid for anything under $20,000.

C. MAINTENANCE REPORT—BUDDY FORRER

Public Works dug in header pipe and then it got installed within week, ready for aeration. All aeration parts are in at Wastewater Treatment Plant. Challand Road gravel was done and spread. They are finishing mowing. Larson-Davis fixed two streetlights, ComEd fixed others that Buddy reported as out. Alley streetlight behind R&R flickers, Buddy said he will call it in.

1. CHILDREN AT PLAY SIGNS: SA-SO is $70+ for just the signs, no posts. Buddy got another company recommended and he is calling them.

2. PART-TIME PUBLIC WORKS FOR WINTER: Buddy talked to Jake and he is available to work as needed throughout winter. Don Goncher asked if we want to plan 20 hours a week during winter and Frank Ottengheime said no more than 20 hours a week. Joe Perkins said to leave hours up to Buddy’s discretion. Sidewalks are done for this year, they will pick up where they left off first thing in Spring. Joe Perkins motioned for a maximum 20 hours a week as needed for winter, Marc Cinnamon seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Richard Lockowitz-aye, Joe Perkins-aye, Josh Clark-aye, Frank Ottengheime-aye. Motion carried.

Don Goncher asked board about tabled speed limit discussion and decision on traffic study required by state statute. Frank Ottengheime asked about cost of study. There was no motion.

D. SHABBONA PATHWAY COMMITTEE—MARC CINNAMON

Two weeks ago 4 engineering firms submitted presentation of qualifications to bid for pathway project engineering. This Wednesday 10/30, 3 engineering firms are being interviewed and then committee will make recommendation for firm. The 4th firm withdrew their bid.

E. RPC REPORT—DEPUTY CLERK LAURIE WILSON

Laurie Wilson attended RPC meeting with Dan and will be taking Dan’s seat on committee. Everyone in attendance talked about their plans for improving communities. Census 2020 was a big part of conversation. Takeaways from Census discussion was $1800 per person per year for 10 years and the importance of census participation by everyone. There is also a grant for $5000 for local libraries and only one library in DeKalb County has taken advantage of this grant. Laurie is sharing grant info with Flewellin Memorial Library. She will become official member of committee at one of the next meetings.

F. SHABBONA HORTICULTURAL COMMITTEE—MARC CINNAMON

1. TREE PRUNING/REMOVAL: There will be dead wood & pruning along all of Illini, Navaho, Cherokee and North Pontiac Streets—raising up all branches to 14’ above street. Work along South Shabbona Road where there is an extremely large limb that is dead. In Water Tower Park, they will be removing honey locust that is in poor condition, a small fir tree next to pavilion that is spindly, big pin oak has a lot of dead branches, and they will thin out maple and crabapple trees. Removing remaining ornamental pear trees along Route 30. Plan is to get Park done before 12/6 and rest complete shortly after. Stephens Tree Service will do work for $6923.25. Next year shorter streets will get same dead wood/pruning. Committee will not exceed $20,000 appropriated for year. Marc will talk to DeKalb County about Shabbona Road trees and some things County needs to do by next year.

G. SHERIFF REPORT - Reviewed Sheriff’s report. Marc Cinnamon asked what Fraud/Scam call was, Don Goncher will find out.

H. CLERK & DEPUTY CLERK

1. APPROVAL OF MINUTES- Frank Ottengheime motioned to approve the minutes. Richard Lockowitz seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime- aye, Joe Perkins-aye, Josh Clark-aye, Richard Lockowitz-aye. Motion carried.

2. HOLIDAY FESTIVAL OF LIGHTS-DEPUTY CLERK

Tree lights will be the biggest expense, Laurie is asking for Board to approve $1855.00 for First Annual Holiday Festival of Lights. Joe Perkins motioned to accept $2000 option. Jamie Deutsch said he was excited about something like this but wondering about CEA involvement. Laurie contacted CEA President and got asked some questions but never heard back on CEA wanting to be part of festival. Village doing for community this year and another organization will need to take it over next year. Josh Clark seconded. Frank Ottengheime said that Fire Department has tried to light up tree in past and unable to get around entire tire. Laurie will look into other tree options for lights. Marc can donate 12- 16 tree tops that will be available after Thanksgiving. Joe Perkins motioned to approve $2000 budget for festival, Josh Clark seconded. Roll Call Vote: Richard Lockowitz-aye, Jamie Deutsch-aye, Joe Perkins-aye, Josh Clark-aye, Marc Cinnamon-aye, Frank Ottengheime-aye. Motion carried.

FINANCIALS

A. APPROVAL OF BILLS-Jamie Deutsch motioned to approve the bills, Joe Perkins seconded. Roll Call Vote: Richard Lockowitz-aye, Jamie Deutsch-aye, Joe Perkins-aye, Josh Clark-aye, Marc Cinnamon-aye, Frank Ottengheime-aye. Motion carried.

B. TREASURER’S REPORT-Josh Clark motioned to accept the Treasurer’s report, Joe Perkins seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Frank Ottengheime-aye, Joe Perkins-aye, Josh Clark-aye, Richard Lockowitz-aye. Motion carried. Don Goncher thanked Treasurer and Clerk for audit.

C. UTILITY BILL ISSUES -Bills due Wednesday 10/30 by 6pm, Cindy anticipates 60 late bills being sent out. Business owner was notified about garbage service being required, Buddy can drop set of totes off at store. Second water meter is in discussion with owners at 201 E Cherokee.

OLD BUSINESS

A. WEST CHEROKEE WATER/FIELD TILE-FRANK OTTENGHEIME Talked to Rob Mullins and he is willing to work with Village after crops are out.

B. ADDITION AT PUBLIC WORKS BUILDING-FRANK OTTENGHEIME

Frank talked to Ken, he’s not interested and Zenz building 40x60 $60,000 steel building only no concrete or finishes. Don Goncher said they need to decide what want to put up and have drawings done. Currently paying $6000 year in office rent. Frank Ottengheime brought up the possibility of need for a police station within the next 20 years and Village should plan for that potential eventually. Marc will look into some comparisons from a few villages.

C. ORDINANCE 2019-10-28(A): MUNICIPAL CANNABIS RETAILERS’ OCCUPATION TAX and ORDINANCE 2019-10-28(B): CANNABIS BUSINESS REGULATIONS & CANNABIS REGULATIONS - Josh Clark motioned to approve both ordinances, Joe Perkins seconded. Roll Call Vote: Richard Lockowitz-aye, Jamie Deutsch-aye, Joe Perkins-aye, Josh Clark-aye, Marc Cinnamon- aye, Frank Ottengheime-no. 5-1 Motion carried.

E. INTERGOVERNMENTAL AGREEMENT WITH COUNTY

Keith sent Nathan letter and hasn’t heard back. Substantial savings going thru County and can use MFT, and no engineering. Property between Shabbona Road/RR and Navaho west side as people drive off shoulder, Nathan should have taken care of it.

NEW BUSINESS

A. ORDINANCE 9-6-7 TRAVEL TRAILERS AND RECREATIONAL VEHICLES

Resident asked about parking his camper on his property in town. He wanted to put on gravel but current ordinance is asphalt or cement. Joe Perkins requested to update ordinance to allow solidly packed gravel with blocks under wheels. One positive of solidly packed gravel is drainage in ground versus run off to storm drains. Joe Perkins motioned to amend Ordinance 9-6-7 Subsection D: Parking area may be paved with cement, asphalt, or solidly packed gravel, Richard Lockowitz seconded. Roll Call Vote: Marc Cinnamon-aye, Jamie Deutsch-aye, Richard Lockowitz-aye, Joe Perkins-aye, Josh Clark-aye, Frank Ottengheime-aye. Motion carried.

ADJOURNMENT—Joe Perkins motioned for adjournment at 8:51PM, Josh Clark seconded. All in favor vote aye. Motion carried.
