City of Sandwich City Council met Aug. 7.

Here are the minutes provided by the council:

Mayor Latham called the meeting to order at 7:03 PM followed by the Pledge of Allegiance Roll call was taken:

Present: Mayor Latham, City Clerk Ii, Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton

Quorum established

Also present: City Attorney Gottschalk, City Administrator Penman, Interim Chief Bleichner & EMA Director Ciciora

Audience Comments: Resident, Phyllis Wallington, stressed the issues in her neighborhood are getting out of control. Problems include loud exhaust, vehicles racing, ignoring stop signs and junk on properties.

Alex Quintanilla, owner of Aztech Landscaping addressed the Council with a concern that he had from one of his customers on Dayton Street regarding damage done to the end of the customers driveway. He also expressed concern about consistency in enforcing City Code and Ordinances.

Consent Agenda:

a. Approval of Regular Meeting minutes of July 17, 2023

b. Approval of Committee-of-the-Whole minutes of July 17, 2023

Alderwoman Johnson moved to accept the Consent Agenda as presented. Alderman Littlebrant seconded. Motion pass unanimously on voice vote.

Mayor’s Report:

a. Oath of Office: Mayor Latham swore in Edward Hegland as a new police officer. He will be attending the police academy in August thru December.

b. Sandwich High School Class of 1948 Proclamation: Mayor Latham read a proclamation recognizing the Sandwich High School Class of 1948 that will be holding their 75th class reunion in August.

c. Updated on Pratt Road Solar Field: The County Board will be taking a final vote on the approval of the proposed Pratt Road Solar Field on August 16, 2023 at 7:00 pm Dekalb County Legislative Center, Gathertorium, 200 N. Main St. Sycamore, IL. Council Members and the public are encouraged to attend, if possible.

d. Historical Preservation Committee Appointment: Mayor made a recommendation to appoint Jane Wolf to the Historical Preservation Committee.

So moved by Alderwoman Johnson, and seconded by Alderwoman Erickson. Motion passed unanimously via voice vote.

City Department Reports:

EMA Director Ciciora: No report

Interim Chief Bleichner: No report

Engineering: Curt Dettmann, Senior Project Manager for EEI (Engineering Enterprises Inc.) presented a status on various ongoing city projects:

- ComEd continues to work on Latham Street, and work is anticipated to be completed in October

- Under the 2023 Road Program, Lafayette and Main Streets are completed

- Under the 2023 Sidewalk Program, various sidewalks on College and Hall Streets between Dummer and Main Street, including Green and Wolfe, will be completed by the end of September

- WWTP construction will start in the next week or so

- Water Rate Study will have a second meeting next Monday (August 14th)

Council Reports: None

New Business:

a. Approval of July invoices totaling $ 495,431.66

Motion made by Alderwoman Johnson and seconded by Alderwoman Erickson, approving payment of July invoices as presented. Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant & Whitecotton Nay: Alderman Robinson Motion passed 7:1

b. Approval of 1st Payout for Universal Paving in the amount of $191,069.00 for work completed on Lafayette Street, south Main Street, and 3rd Street as part of the 2023 Pavement Management Program.

Alderman Kreinbrink so moved, and seconded by Alderman Littlebrant. Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion carried 8:0

c. Ordinance 2023-16 entitled “An Ordinance Amending Chapter 86 “Utilities”, Article I “In General”, Section 86-5 “Service Pipes” of the City of Sandwich Municipal Code presented for further discussion and possible passage.

Alderman Kreinbrink moved to table Ordinance 2023-16, as presented. Alderwoman Johnson seconded. Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion carried 8:0

d. Ordinance 2023-17 entitled “An Ordinance Amending Chapter 70 “Streets and Sidewalks”, Article I “General”, Section 70-20 “Driveways” of the City of Sandwich Municipal Code was presented for passage. Attorney Gottschalk advised that under paragraph c, page 2, wording needed to be amended from “must be poured flush……” to “must be installed flush…”.

Alderman Kreinbrink moved to pass Ordinance 2023-17, as amended by Counsel. Motion was seconded by Alderman Arnett. Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion carried 8:0

e. Lauterbach & Amen Engagement Agreement: Motion requested authorizing the mayor to sign an Understanding of Services with Lauterbach & Amen. The annual fee for accounting assistance increased by 3%, or $4,725/month until April 30, 2024.

Motion was made by Alderman Littlebrant authorizing Mayor Latham to enter into an agreement with Lauterbach & Amen for accounting assistance. Motion was seconded by Alderwoman Erickson. Aye: Aldermen Arnett, Erickson, Frirtsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion carried unanimously

f. Intergovernmental Agreement (IGA) with Plano: Seeking motion to authorize the mayor to enter into an intergovernmental agreement (IGA) with the City of Plano to utilize Plano’s tar and chip emulsions storage tank. At the July 3rd meeting, Council approved the purchase of a Total Patcheer Vortex not to exceed $95,740 on the condition that the City secure an IGA with Plano to utilize their existing tar and chip emulsions storage tank. The cost for the City to purchase would be an additional $40,000, plus a location to install the tank.

Alderwoman Johnson moved authorizing the mayor to enter into an IGA with Plano, as present. Alderman Arnett seconded. Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion passed 8:0

g. Water Tower Exterior Repainting Bid Award: Motion sought to award bid on the 300,000 gallon spheroid for rehabilitation and repainting to Era Valdivia Contractors, Chicago, IL, in the amount of $589,700. Work will begin mid-September.

So moved by Alderman Whitecotton, and seconded by Alderwoman Erickson. Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion carried unanimously

Executive Session: Motion made by Alderwoman Johnson to enter into Executive Session at 7:37 PM under 5 ILCS 120/2(C)(1) for personnel “The appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body or legal counsel for the public body, including hearing testimony on a complaint lodged against an employee of the public body or against legal counsel for the public body to determine its validity”; under 5 ILCS 2(c)(2) for collective bargaining “Collective negotiating matters between the public body and its employees or their representatives, or deliberations concerning salary schedules for one or more classes of employees; and under Section 2(c)(11) imminent litigation “Litigation, which an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent”. Alderman Fritsch seconded. Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion carried 8:0

Alderwoman Johnson moved to return to open session at 9:23 PM, and seconded by Alderwoman Erickson Aye: Aldermen Arnett, Erickson, Fritsch, Johnson, Kreinbrink, Littlebrant, Robinson & Whitecotton Nay:0 Motion passed unanimously

Announcements: The next Finance Committee Meeting is August 21st, 2023 at 6:30 PM. The next Regular Council Meeting is August 21st, 2023 at 7:00 PM immediately followed by the Committee-of the-Whole Meeting.

Next committee meetings are scheduled for Thursday, August 10, 2023:

8:00 PM - Citizens Advisory Committee

Adjournment: There being no further business to come before the Council, motion made by Alderman Robinson and seconded by Alderwoman Erickson to adjourn the Regular Council meeting at 9:25 PM. Motion carried unanimously via viva voce vote.
