A. MOTION TO APPROVE THE CONSENT AGENDA THAT INCLUDES THE FOLLOWING ITEMS:

6. APPROVE AN ORDINANCE ADOPTING TITLE 3 AND APPENDIX A OF THE MUNICIPAL CODE OF THE CITY OF GENOA
Throughout 2024, City Staff has been reviewing individual Titles within the Municipal Code. In consultation with our City Attorney, Staff is looking for inconsistencies with current practices, policies, and/or State Law. In October 2024, Staff presented Council with a draft of the newly revised Title 3. Changes included removal of many types of licenses and permits for things such as pool tables, dry cleaning machines, and theatrical exhibitions. Further, certain areas of the code were redundant and therefore consolidated as well as many of the fees removed from Title 3 and placed in Appendix A. In addition to Council review, the City’s consulting Attorney has reviewed the final draft ordinance.
VII. NEW BUSINESS
A. ACCEPT THE FISCAL YEAR 2024 POLICE PENSION FUND MUNICIPAL COMPLIANCE REPORT AND FUNDING ACTUARIAL VALUATION REPORT
Each Year, the Police Pension Fund has an Actuarial Valuation Report completed to determine the recommended annual Municipal Contribution to the Police Pension Fund to meet State Statute funding requirements. These reports consider current Fund balance, active member’s future pension benefits, current pension benefits being paid, investment returns and the projected unfunded liability.
B. APPROVE AN ORDINANCE AMENDING TITLE 9 OF THE MUNICIPAL CODE OF THE CITY OF GENOA
The State of Illinois recently passed Public Act 103-0510, which created a statewide building code that becomes effective January 1, 2025. The act allows units of government to adopt the code of their choice, however, the building code must be published during the current year or preceding 9 years. The City of Genoa’s current adopted code is the 2012 Edition of the International Code Council (ICC), therefore it does not meet statutory requirements and a new edition of the ICC must be adopted in order to comply.
This ordinance amends Title 9 “Building Code” of the Municipal Code by adopting the 2021 Edition of the ICC and the 2023 Edition of the National Electrical Code. These codes, which regulate building construction and fire prevention within the City, were last updated in 2022 to the 2012 Edition. Staff consulted with DeKalb County, the City of DeKalb, and the City of Sycamore, all who are likely to adopt the same edition in order to promote consistency for those performing construction-related activities within DeKalb County. Further, the DeKalb Area Builder’s Association has reviewed these codes and indicated their support of the adoption with amendments as included in the packet.
C. APPROVE THE 2023 TAX LEVY DETERMINATION FOR THE CITY OF GENOA
Staff has prepared the 2024 Tax Levy Determination:
City of Genoa $ 984,000
Genoa Riverbend SSA $ 123,190
Derby Estates SSA $ 10,000
Genoa Oak Creek Estates SSA #4 $ 19,880
The tax levy determination being presented results in a 3.51% reduction in the City of Genoa’s tax rate. A detailed presentation will be provided at the City Council meeting. A Public Hearing and final approval will take place at the December 4, 2024 meeting.
D. APPROVE AN ORDINANCE AUTHORIZING THE EXECUTION OF THE RMA MINIMUM/MAXIMUM CONTRIBUTION AGREEMENT
In 2023 the City began purchasing insurance from the Illinois Municipal League Risk Management Association (IMLRMA). IMLRMA provides insurance to the City in the case of workers compensation, auto liability, general liability, property damage, and so on. For 2025 coverage, the City was presented with a quote for a net 6.23% increase for the same coverage as 2024. City Staff is happy with their service and support, which includes staff training to reduce risk, claims made and helps meet OSHA requirements.
E. APPROVE AN ORDINANCE AMENDING TITLE 7, CHAPTER 9, SECTION 5, SMALL WIRELESS FACILITIES REGARDING ANNUAL RECURRING RATES
The Illinois Small Wireless Facilities Deployment Act (50 ILCS 840/1 et. seq.) was passed in 2018 and subsequently updated to regulate the installation of 5G “small cell” technology at the local level. The IML adopted and later updated a model “Small Cell Ordinance”, and the City of Genoa has adopted versions largely based on that ordinance including the fees that were set by state law.
This past summer, the Governor signed Illinois Public Act 103-0601 which now authorizes municipalities to increase the annual small wireless facility poll attachment fees to $270 per year (from $200 per year) or more if such amount were to be properly authorized by the Federal Communications Commission (“FCC”). This draft ordinance increases the fees to $270 per facility and also authorizes further increases if authorized by the FCC so the Code does not need to be continuously amended.
F. WAIVE THE BID PROCESS AND APPROVE A PROPOSAL FROM UNITRIM CEMENT & LANDSCAPING FOR SIDEWALK REPLACEMENT SERVICES TOTALING $38,803.55
Sidewalk replacement proposed includes sidewalks on 2nd Street, Washington Street, South Emmett Street, South Hadsall Street, Jackson Street and South Sycamore Street. All of these sections of sidewalk were prioritized following a sidewalk inventory. Additional information is included in the packet.
G. APPROVE A FIFTH AMENDMENT TO LAND LEASE AGREEMENT DATED AUGUST 1, 1995 BY AND BETWEEN THE CITY OF GENOA (“LANDLORD” AND GTE WIRELESS OF THE MIDWEST INCORPORATED D/B/A VERIZON WIRELESS (“TENANT)
