City of Naperville City Council met Sept. 2.

A motion was made by Councilman White, seconded by Councilman Kelly, to recess to Closed Session to discuss [5 ILCS 120/2(c)(21)] Approval of Minutes, [5 ILCS 120/2(c)(21) Semi-Annual Review of Closed Session Minutes, and [5 ILCS 120/2(c)(3) Selection of a Person to Fill a Vacancy in Public Office. The motion carried by the following vote:

E. PLEDGE TO THE FLAG:

A motion was made by Councilman White, seconded by Councilman Holzhauer, to allow Councilman Kelly to participate via teleconference due to child care issues. The motion carried by a voice vote.

F. AWARDS AND RECOGNITIONS:

1. Proclaim September 5-6, 12-13, 27-28 and October 4-5, 10-12, 2025 as Kiwanis Peanut Days in the City of Naperville

The proclamation was presented by Councilman Holzhauer.

G. PUBLIC FORUM:

SPEAKERS

Citizen participation in government

Paul Deffenbaugh (Naperville) discussed the importance of NEST and its volunteers to the Naperville community.

Who is NEST?

Ted Bourland (Naperville) discussed the importance of NEST and its volunteers to the Naperville community.

IMEA

Dick Furstenau (Naperville) spoke in favor of renewing the IMEA contract.

Council discussed the importance of civility, decorum and respect from the dais no matter the issue or the subject being debated and thanked the Naperville Jaycees, volunteers and City staff who supported the Last Fling over the Labor Day weekend.

H. CONSIDERATION OF MOTION TO USE OMNIBUS METHOD FOR THE CONSENT AGENDA:

A motion was made by Councilman White, seconded by Councilman Holzhauer, to use the Omnibus method to approve the Consent Agenda. The motion carried by a voice vote.

I. CONSENT AGENDA:

A motion was made by Councilman White, seconded by Councilman Holzhauer, to approve the Consent Agenda. The motion carried by the following vote:

1. Approve the regular City Council meeting minutes of August 19, 2025

Council approved.

2. Approve the Long-Term Energy Options Workshop meeting minutes of July 28, 2025 Council approved.

3. Approve the City Council meeting schedule for September, October, and November 2025

Council approved.

4. Approve the award of Sole Source Procurement 25-256, Naviline Public Administration Software Maintenance and Support, to CentralSquare Technologies for an amount not to exceed $167,839.41 and for a one-year term

Council approved.

5. Approve the award of Change Order #1 to Work Order 22-114-4, Engineering Services for Central Elevated Water Tank Relocation, to Baxter & Woodman, Inc. for an amount not to exceed $99,472 and for an additional one year

6. Waive the first reading and pass the ordinance amending Section 3-3-11:1 of the Naperville Municipal Code to allow the sale and service of spirits at a Class M - Lifestyle Amenities Facility (requires six positive votes)

J. PUBLIC HEARINGS:

1. Concur with the petitioner and open the public hearing for Everly Trace (DEV-0010-2025) and continue the case to the October 7, 2025 City Council meeting

Mayor Wehrli opened the Public Hearing at 7:24 p.m.

A motion was made by Councilman White, seconded by Councilman Holzhauer to close the public hearing at 7:24 p.m. for Everly Trace (DEV-0010-2025) and continue the case to the October 7, 2025 City Council meeting. The motion carried by a voice vote.

L. ORDINANCES AND RESOLUTIONS:

1. Pass the ordinance amending Chapter 1, Title 3 of the Naperville Municipal Code to establish a Municipal Grocery Retailers’ Occupation Tax and a Municipal Grocery Service Occupation Tax

A motion was made by Councilman White, seconded by Councilman Holzhauer to table the ordinance amending Chapter 1, Title 3 of the Naperville Municipal Code to establish a Municipal Grocery Retailers’ Occupation Tax and a Municipal Grocery Service Occupation Tax to the September 16, 2025 Council meeting.

The motion carried by the following vote:

P. NEW BUSINESS:

Update on the IMEA Negotiations

White requested an update on the IMEA negotiations authorized by Council at the August 19, 2025, meeting.

Krieger stated staff is currently working two separate tracks based on Council's direction from the August 19, 2025 meeting. 1) An RFP is being developed to determine cost and availability of renewable resources the City could acquire to meet the MDR provision of a successor IMEA contract. The RFP will be placed on the September 16, 2025 agenda for approval before being released to vendors. 2) The City has shared the nine items approved by Council on the August 19, 2025 Council meeting with IMEA, and both parties are continuing to work toward mutually agreeable terms for a successor agreement. This agreement must be approved by the IMEA Board of Directors, which meets October 23, 2025.
