Court rules former NIU president's severance agreement violated Opening Meetings Act

A DeKalb County Circuit judge granted summary judgment in favor of the plaintiff in a suit brought against the board of Northern Illinois University concerning an alleged violation of part of the Open Meetings Act regarding a severance agreement with former NIU President Douglas Baker.

EdgarCountyWatchdogs.com reported on Nov. 22 that the judge ruled in favor of Misty Haji-Sheikh whose suit claimed the board's final action on Baker's severance agreement was not valid because it violated the Open Meetings Act, specificially Section 2.02(c), which deals with public notice of meetings. The complaint charged that the public was not given proper notice about the action to approve Baker's severance agreement, and the court agreed.

“The nullified agreement was worth over $700,000 to Baker, and we contend that neither he, nor the board, have any grounds to go back and approve any transition agreement, since he is already past the transition stage,” Kirk Allen wrote on the website.
