City of Sandwich Committee-of-the-Whole Council met January 7. 

Here is the minutes as provided by the council:

Mayor Olson called the Committee-of-the-Whole Council Meeting to order at 7:00 PM.


Roll call was taken:

     Present:          Mayor Olson, City Clerk Ii, Aldermen Chmielewski, Dell, Kelleher, Killey, McMahon, Redden, Robinson & Surratt

     Also present:   Attorney Harrill, Department of Public Works / City Engineer Horak, EMA Director Ciciora, City Treasurer Webber & Chief Bianchi

Mayor Olson:

Ordinance 2019-01 entitled “Supplemental Ordinance Correcting a Scrivener’s Error in Ordinance 2018-21 entitled “Ordinance Abating the Tax Heretofore Levied for 2018 to Pay the Debt Service on a Portion of $5,600,000 General Obligation Waterworks Refunding Bonds (Alternate Revenue Source) of the City of Sandwich, DeKalb & Kendall Counties, Illinois”. Ordinance is being presented for first reading correcting a typographical error in the original Tax Abatement Ordinance 2018-21.

Continued Discussion on Lil’ Monkeys Daycare: Mayor Olson explained that the Council has three options for discussion being (a) accept the Plan Commission recommendation denying the special use request; (b) not accept the Plan Commission’s recommendation, or (c) return the request for a special use to the Plan Commission for further consideration. A fourth option was suggested of tabling a final decision pending further investigation of other daycare facilities within the City. The Mayor indicated that additional correspondence had been received for and against approving the special use request. Alderman Redden had polled four members of the Plan Commission asking why they voted ‘no’. The consensus was noise complaints, the size of the operation, and the number of staff, making the daycare more akin to a corporate daycare rather than an in-home day care. Although audience comments were heard in support of the facility, Council stressed that the quality of the daycare facility was not in question but rather a zoning issue, hence the need for a special use permit. The property is located in a R-1 residential district, and to operate a daycare facility, a special use permit is required. Council will make a decision at next week’s meeting.

Executive Session under Section 2(c)(1) on personnel will be held at the end of the meeting. No action will be taken.

Director of Public Works / City Engineer Horak:

Plan Commission regular meeting will meet on Tuesday, January 8, 2019 at 6:30 pm in the City Hall Annex. The public hearing on PC2019-01 will be held on a request of recommendation for approval of a zoning change from existing B-3 Service, Automotive, and Wholesale Business District to R-5 General Residence District allowing for a 55-unit, three-story apartment building.

Chief Bianchi reported that the IDOT grant discussed several weeks ago has been received, and the drug fund has been reimbursed. Additionally, Chief Bianchi requested Executive Session at the end of the meting under Section 2(c)(1) for personnel.

EMA: No report

Alderwoman Chiemlewski: No report

Alderman Dell: No report

Alderman Kelleher: No report

Alderwoman Killey advised that the finance committee would meet immediately following this evening’s Council meeting.

Alderman McMahon: No report

Alderman Redden: No report

Alderman Robinson: No report

Alderman Surratt: No report

New Business: None

Executive Session

Motion made by Alderman Kelleher and seconded by Surratt to go into executive session at 7:59 PM, pursuant to Section 2(c)(1) “The appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body or legal counsel for the public body, including hearing testimony on a complaint lodged against an employee of the public body or against legal counsel for the public body to determine its validity”. It was noted that no action would be taken resulting from the Executive Session. Aye: Aldermen Chmielewski, Dell, Kelleher, Killey, McMahon, Redden, Robinson & Surratt Nay:0 Motion carried 8:0

Motion to return from Executive Session: Motion made by Alderman Redden and seconded by Alderman Robinson to return to regular session at 8:37 PM. Motion carried unanimously by voice vote.

Adjournment: There being no further business to come before the Council, motion made by Alderman Robinson and seconded by Alderman Redden to adjourn the Committee-of-theWhole Council meeting at 8:40 PM. Motion carried unanimously by voice vote.
