The DeKalb County Board met in regular session at the Legislative Center’s Gathertorium at 7:00 p.m. Chairman Frieders called the meeting to order and the Clerk called the roll. Those Members present were Ms. Michelle Pickett, Mr. Roy Plote, Mr. Craig Roman, Mr. Ellingsworth Webb, Vice-Chair Suzanne Willis, Mr. Tim Bagby, Mr. Scott Campbell, Ms. Mary Cozad, Ms. Rukisha Crawford, Mrs. Karen Cribben, Mr. Bill Cummings, Mr. Patrick Deutsch, Mr. John Emerson, Mrs. Laurie Emmer, Mr. Steve Faivre, Mrs. Kathy Lampkins, Ms. Dianne Leifheit, Ms. Maureen Little, Mr. Jim Luebke, Ms. Terri Mann-Lamb, Mr. Osland, and Chairman John Frieders. Those absent were Mr. Larry West and Ms. Kiara Jones. A quorum was established with twenty-two Members present and two absent.
Chairman Frieders asked Ms. Pickett to lead in the reciting of the Pledge of Allegiance.
APPROVAL OF AGENDA
Motion
It was moved by Mr. Webb and seconded by Mr. Roman to approve the agenda as presented. Voice Vote
Chairman Frieders called for a voice vote to approve the agenda as presented. All Members present voted yea. Motion carried unanimously.
APPROVAL OF MINUTES
Motion
Mr. Faivre moved to approve the minutes of the May 18, 2022 County Board Meeting. Mrs. Emmer seconded the motion.
Voice Vote
Chairman Frieders asked for a voice vote on the approval of the minutes. All Members voted yea. Motion carried unanimously.
COMMUNICATIONS AND PROCLAMATIONS
Employee Service Awards
Chairman Frieders and the Board recognized the following County Employees who celebrated a Service Award in the month of June 2022: Five Years: Maria Cintora – Rehab & Nursing Center, Jeremy Bagg – Highway Department, Holly Kuhn – Health Department; Fifteen Years: Kelly King – Sheriff’s Office, Susan Scheffler – Health Department; Twenty-Five Years: Karlene Dolder – Coroner’s Office; Thirty Years: Maliheh Ardehali – Rehab & Nursing Center.
PUBLIC COMMENTS
Mr. Jacob Nates addressed the Board and strongly encouraged them not to vote to sell the DCRNC.
A representative from the Sycamore Creek HOA expressed his concerns with a meeting that was promised to take place that has yet to regarding the placement of stoplight at the intersection of Lindgren and Plank Road in Sycamore Township.
Ms. Amanda Meyer of Sycamore Township, resident and HOA member the Sycamore Creek subdivision addressed the committee with her concerns regarding Lindgren and Plank Road intersection.
Mr. Ted Strack of Sycamore, suggested not selling the DCRNC but to hire the best management company they can to come in and turn the facility around.
Ms. Lori Laidlaw, American Federation of State, County and Municipal Employees (AFSCME) Council 31, AFL-CIO, Local 3537, pleaded with the Board to not sell the Nursing Home and noted that Mr. Campbell provided a good model and staff can continue to find ways to make cuts. She also described how Illuminate Hc, LLC would not be a good buyer for the facility.
Mr. Tom Kapraun, Village of Lee, requested that the Board not sell the Nursing Home but fix it.
Ms. Kaitlin Fair, Activities Director of the DCRNC, read a letter from a fellow co-worker outlining their experience in working in profit and non-profit facilities. She also outlined how the individual commutes one hour each way to work at the DCRNC because the facility is like no other around.
Ms. Mary Roman, DCRNC resident and President of the DCRNC’s Resident Council, expressed how much she loves living at the DCRNC the way it is now and doesn’t want to live in fear of living uncomfortably if the facility were to sell.
Mr. Chuck Coulter, DCRNC Maintenance Staff and President of AFSCME Local 3537, relayed the fears of residents that are living in the DCRNC to the Board. He also expressed that Illuminate Hc, LLC is a facility that no one wants to chose to go to.
Ms. Hannah Williams, a staff member of the DCRNC, shared her experiences working at the DCRNC more than once and she also expressed how Illuminate would not be a good buyer for the County Home.
DCRNC Administrator Magdalen Niemi shared that the census at the facility is now 127 and explained how the DCRNC is a very viable facility. She also noted that they have corrected the previous problems and are now properly billing. Ms. Niemi urged the Board not to sell the DCRNC because there is so much more to be done and their reliance on the County will diminish.
APPOINTMENTS
Chairman Frieders recommended approval of the following appointments:
a. County Historian: Michelle Donahoe reappointed for a two-year term beginning July 1, 2022 and expiring June 30, 2024.

Ordinance O2022-07: An Ordinance Approving a Special Use Permit for a Solar Garden for Property Located on Pearl Street in Franklin Township
Motion
Mr. Faivre moved that the DeKalb County Board hereby approves a Special Use Permit (FR-22- 02), with conditions as outlined in the Ordinance, requested by Sunvest Solar, Inc. for the construction and operation of a 2-megawatt Solar Garden (SV CSG Kirkland 1, LLC) on property on the east side of Pearl Street, in Franklin Township (P.I.N.: 01-24-100-001). Mr. Roman seconded the motion.

Ordinance O2022-08: An Ordinance Approving a Special Use Permit for a Solar Garden for Property Located on Pearl Street in Franklin Township

Mr. Faivre moved that the DeKalb County Board hereby approves a Special Use Permit (FR-22-03), with conditions as outlined in the Ordinance, requested by Sunvest Solar, Inc. for the construction and operation of a 2-megawatt Solar Garden (SV CSG Kirkland 2, LLC) on property on the east side of Pearl Street, in Franklin Township, co-located with SV CSG Kirkland 1, LLC (P.I.N.: 01-24-100- 001). Ms. Mann-Lamb seconded the motion.

Ordinance O2022-09: An Ordinance Approving a Special Use Permit for a Concrete Business for Property Located at 1275 E. State Street in Sycamore Township

Mr. Faivre moved that the DeKalb County Board hereby approves a Special Use Permit, with conditions as outlined in the Ordinance, for Doty & Sons Concrete Products for the expansion of their existing business and for the construction of a new storage building on property located at 1275 E. State Street in Sycamore Township. Mrs. Lampkins seconded the motion.

Ordinance O2022-10: An Ordinance Approving a Zoning Map Amendment for 1120 E. State Street in Sycamore Township

Mr. Faivre moved that the DeKalb County Board hereby approves, with conditions as outlined in the Ordinance, a Zoning Map Amendment to Keith Parks Enterprises Inc d/b/a Accurate Towing for the rezoning of the property located at 1120 E. State Street in Sycamore Township from BC, Business Conservation District to PD-I, Planned Development – Industrial in order to allow for the operation of a vehicle repair facility and the establishment and operation of a vehicle storage yard. Mrs. Emmer seconded the motion as presented.

Resolution R2022-72: A Resolution Approving a Five-Year Extension with DEVNET for Property Tax Software
Motion
Mrs. Emmer moved that the DeKalb County Board hereby authorizes the County Board Chairman to execute the five-year extension with DEVNET for Property Tax Software, at annual cost of Fifty Nine Thousand Four Hundred Ninety-Eight Dollars and Ninety-Two Cents ($59,498.92) as outlined in Exhibit A. Mr. Emerson seconded the motion.

Resolution R2022-73: A Resolution Approving a Letter of Support for the Request of Additional Downstate Operating Assistance Program Funds
Motion
Ms. Crawford moved that the DeKalb County Board hereby approves and directs the Chairman of the Board to sign the attached Letters of Support for the request of additional Downstate Operating Assistance Program (DOAP) funds to address future operating expenses of the Voluntary Action Center transit system to provide transportation services to the residents of DeKalb County. Ms. Little seconded the motion.

Resolution R2022-178: A Resolution Memorializing the Restructuring and Assigning Certain Finance Duties and Functions
Motion
Mr. Bagby moved that the DeKalb County Board does hereby approve and memorialize the Restructuring including the assignment of certain finance duties and functions. This Resolution and the functions outlined herein may be evaluated, modified, and repealed as needed. Ms. Pickett seconded the motion.

Resolution R2022-179: A Resolution Establishing the Salary for the DeKalb County Sheriff Motion
Mr. Bagby moved that the DeKalb County Board hereby approved that effective December 1, 2022, the DeKalb County Sheriff’s annual salary shall be set at no less than eighty percent (80%) of the DeKalb County State’s Attorney’s salary as is set by the State of Illinois pursuant to Section 4-2001 of the Counties Code inclusive of any cost-of-living adjustments as authorized by the Compensation Review Board. In addition to the salary, the Sheriff shall receive an annual stipend to be paid by the Illinois Department of Revenue out of the Personal Property Tax Replacement Fund in the amount of six thousand five hundred dollars ($6,500.00) as required by Section 4-6003(d) of the Counties Code [55 ILCS 5/4-6003(d)], and the definition of benefits for the DeKalb Sheriff shall be defined by the County Board of DeKalb County and shall be consistent with the other county-wide elected officials. Mr. Webb seconded the motion as presented.

Resolution R2022-180: A Resolution Authorizing the Execution of Documents for the DATA Fiber Network Transfer and Establishing the Official Financial Control Transfer Date Motion
Mr. Bagby moved that the DeKalb County Board hereby authorizes the Chairman of the Board to execute the necessary agreements between DeKalb County Government and Syndeo Networks, Inc., including all ancillary documents, which will allow for the transfer of assets and liabilities of the County's fiber optic network known as "DATA" with an effective date of January 20, 2021. Mrs. Lampkins seconded the motion.

Resolution R2022-181: A Resolution Approving the Procurement of CrowdStrike Antivirus Protection Software

Mr. Bagby moved the DeKalb County Board hereby authorizes the procurement of CrowdStrike Antivirus Software, in the amount not to exceed Forty-Six Thousand Forty-Seven Dollars and Thirty-Six Cents ($46,047.36) annually. Mrs. Emmer seconded the motion.

Resolution R2022-182: A Resolution Approving Amendments to the FY2022 Budget Motion
Mr. Bagby moved that the DeKalb County Board hereby approves the attached Exhibit “A”, which includes FY2022 budget amendments. These amendments address re-alignment of funds in Court Services and Probation Services based on direction from the Illinois Administrative Office. Ms. Leifheit seconded the motion as presented.
Voice Vote
The Chairman called for a voice vote on the motion. All Members present voted aye. The motion carried unanimously.
Claims – June 2022
Motion
Mr. Bagby moved to approve the payment of claims for this month, and the off-cycle claims paid during the previous month, including all claims for travel, meals, and lodging, in the amount of $5,900,230.54. Ms. Pickett seconded the motion.
Roll Call Vote
Chairman Frieders asked for a roll call vote on the approval of the June 2022 Claims. Those Members voting aye were Ms. Pickett, Mr. Plote, Mr. Roman, Mr. Webb, Vice-Chair Willis, Mr. Bagby, Mr. Campbell, Ms. Cozad, Ms. Crawford, Mrs. Cribben, Mr. Cummings, Mr. Deutsch, Mr. Emerson, Mrs. Emmer, Mr. Faivre, Mrs. Lampkins, Ms. Leifheit, Ms. Little, Mr. Luebke, Ms. Mann-Lamb, Mr. Osland, and Chairman Frieders. All Members present voted aye. The motion carried unanimously.

EXECUTIVE COMMITTEE
Resolution R2022-183: A Resolution Approving the Appointment of Election Judges Motion
Vice-Chair Willis moved that the DeKalb County Board hereby appoints those persons named in the Certified Lists of Candidates for Judges of Election submitted by the Central Committees of the DeKalb County Democratic Party and Republican Party and prepared by the County Clerk. Mr. Luebke seconded the motion.
Voice Vote
Chairman Frieders called for a voice vote on the motion. All Members present voted aye. The motion carried unanimously.

Resolution R2022-184: A Resolution Authorizing the Chairman of the Board to Execute a Non Binding Letter of Intent with Illuminate HC for the Purchase of the DeKalb County Rehab & Nursing Center
Motion
Vice-Chair Willis moved that the DeKalb County Board hereby authorizes the Chairman of the Board to execute a Non-Binding Letter of Intent between the DeKalb County Government and Illuminate HC to purchase the DeKalb County Rehab & Nursing Center in the amount of $8,150,000. Mr. Faivre seconded the motion.
After some initial comments and questions, Mr. Israel Davis of Illuminate Hc, LLC, joined the Board and reviewed background information about the company and their Letter of Intent for the purchase of the DeKalb County Rehab & Nursing Center.
Motion
Ms. Crawford made a motion to Refer the Resolution Back to the Executive Committee. Mr. Osland seconded the motion.
Voice Vote
The Chair called for a voice vote. All Members voted yea. Motion carried unanimously.
