Village of Shabbona Board of Trustees met July 24.

Here are the minutes provided by the board:

The Regular Meeting of the Shabbona Village Board was called to order by Village Trustee Marc Cinnamon on Monday, June 24, 2024 at 7:00 P.M. in the meeting room at Village Hall, 206 S. Blackhawk Street, Shabbona IL. The following were present:

OPENING OF MEETING/PLEDGE OF ALLEGIANCE/ ROLL CALL

Roll Call Vote: Marc Cinnamon-aye, Allison Kidd Probst-aye, Denny Sands-aye, Joy Fay-aye, David Simpson-aye, Geoff Cooker-aye. 6 present.

ADDITIONS TO THE AGENDA – David Simpson: fire department retaining wall

APPROVAL OF AGENDA – David Simpson motioned to approve the agenda, Allison Kidd Probst seconded. All in favor vote aye, motion carried.

CITIZENS ADDRESSING THE BOARD:

• Beth Einsele – changed mind, no comment

• Laura Shepp – thanked the board for professionalism during negative posts and comments.

REPORTS and ACTION

A. VILLAGE ENGINEER: Curtis Cook

1. PROJECT UPDATES:

a. Shabbona Road: Currently on South Shabbona Road, have about 3 weeks left to go, putting in 100’-125’ a day. Curtis said that they appreciate everyone’s patience with all the construction going on. Denny Sands asked about running water on Shabbona Road—it is because they are continuously flushing the system.

b. Apache Street: paved Friday, looks really good, rainfall over weekend, storm was good. Seeding will be done in September when the temperature is cooler. Finishing some signs and winding up otherwise.

B. PUBLIC WORKS REPORT-BUD FORRER: This week Buddy is on vacation, John will be reading water meters, monitoring all the projects, picked up junk during clean up two weeks ago and got $119 for scrap metal.

C. COMMITTEE REPORTS:

1. FINANCE COMMITTEE-ALLISON KIDD PROBST: no update

2. INFRASTRUCTURE COMMITTEE-MARC CINNAMON: Talked to Fehr Graham about a few concerns downtown, some amenities are on backorder, railings have to be fabricated since there were changes to the sidewalk plans and will be installed as soon as they are ready – probably after 4th of July—anywhere there is a step there will be a railing.

3. DEVELOPMENT COMMITTEE-ALLISON KIDD PROBST: Going to be applying for Oslad Grant in September. Need to hold a public hearing for Purdy Park prior to applying for OSLAD grant, would like to do on Thursday, July 18, 2024, 6pm at Resource Bank Quilhot Room. Jen will finalize and submit public hearing notice to Daily Chronicle.

4. PUBLIC AFFAIRS COMMITTEE-DAVID SIMPSON: 4th of July festival, craft show and parade. Community Garden looks nice and people are taking care of their plots.

D. DEKALB COUNTY SHERIFF – reviewed Sheriff’s report for May 2024

E. VILLAGE CLERK

1. APPROVAL OF REGULAR BOARD MEETING MINUTES FROM MAY 20, 2024- under Utilities, 1, I change Bob Pritchard to Bob Pinegar. David Simpson motioned to approve the minutes of the Board Meeting from May 20, 2024 as amended, Allison Kidd Probst seconded. All in favor vote aye, motion carried.

2. ZONING PERMITS ISSUED TO DATE: reviewed report

3. FOIA UPDATE: Jen provided board an update on FOIA requests this year to date and hours spent on requests.

4. CROSSING GUARD JOB POSTING: Jen posted job on Village website and Facebook page over a week ago, no applications to date. If anyone knows of someone that may be interested, please encourage them to apply.

FINANCIALS

A. APPROVAL OF BILLS AND PAYROLL – Allison Kidd Probst motioned to approve June 2024 bills and payroll, Joy Fay seconded. Roll Call Vote: Allison Kidd-Probst-aye, David Simpson-aye, Denny Sands aye, Marc Cinnamon-aye, Joy Fay-aye, Geoff Cooker-aye. 6-0 Motion carried.

B. TREASURER’S REPORT – Joy Fay motioned to accept the Treasurer’s report as of May 31, 2024, Allison Kidd Probst seconded. Roll Call Vote: Joy Fay-aye, Allison Kidd-Probst-aye, Denny Sands-aye, Geoff Cooker-aye, David Simpson-aye, Marc Cinnamon-aye. 6-0 Motion carried.

C. UTILITY BILLING: nothing to report, reading meters this week

OLD BUSINESS

A. PROPERTY NOTICES/VIOLATIONS UPDATE – no update

B. VACANT BUILDINGS UPDATE: No property owners have registered vacant buildings nor have any requested to present plan for remediation to the board. May invoices were sent out last week. C. PROPERTY MAINTENANCE VIOLATION UPDATE – no update

D. CONSIDERATION/APPROVAL OF ORDINANCE 2024-06-24(A) ADJUDICATION, AMENDING TITLE 4 PUBLIC SAFETY TO CREATE NEW CHAPTER 5 ADMINISTRATIVE ADJUDICATION OF NON-VEHICULAR CODE VIOLATIONS: Keith Foster said that even though the law provides the Ordinance was edited to include the advice and consent of Village Board on the appointment of hearing officers. Marc Cinnamon said that the person who will be appointed has to be a licensed attorney in Illinois and they have to go through training and be approved by the State as an adjudicator. Denny Sands asked if D.1. should include subject to removal by majority vote of the Board of Trustees. Allison Kidd Probst motioned to approve Ordinance 2024-06-24(A) Adjudication as amended including D.1., Geoff Cooker seconded. Roll Call Vote: Allison Kidd-Probst-aye, David Simpson-aye, Denny Sands-aye, Marc Cinnamon-aye, Joy Fay-aye, Goeff Cooker aye. 6-0 Motion carried.

E. FIRE DEPARTMENT RETAINING WALL/DRAINAGE: Curtis Cook said that they have requested estimates for work and are waiting on those. David Simpson asked to see more progress on this so work happens before too late in the year.

NEW BUSINESS

A. CONSIDERATION/APPROVAL OF ORDINANCE 2024-06-24(B) ADOPTING AND ENACTING A NEW CODE (ORDINANCES) FOR THE VILLAGE OF SHABBONA: This ordinance is to accept Municode as the Village’s Code of Ordinances so that we can go live with Municode. All existing ordinances have been put into Municode with exception of some outdated items that were removed during legal review, items that are in state statute and were outdated in Village code, and rates/fees that were all removed and put into the Rates/Fees schedule that is posted on village website. Allison Kidd Probst motioned to approve Ordinance 2024-06-24(B) Adopting and Enacting a New Code for the Village of Shabbona, David Simpson seconded. Roll Call Vote: Allison Kidd-Probst-aye, David Simpson-aye, Denny Sands-aye, Marc Cinnamon aye, Joy Fay-aye, Goeff Cooker-aye. 6-0 Motion carried.

B. OSLAD GRANT – CONSIDERATION/APPROVAL FOR VILLAGE PLANNER TO DO OSLAD GRANT APPLICATION FOR PURDY PARK FOR ESTIMATE OF $2,500: BST sub-committee has been working park plan and should have estimates by end of this week. David Simpson asked if $2,500 is reimbursable from the grant if awarded. The Grant is 50/50. Marc Cinnamon said he believes that grant can pay for a lot of what is planned for the park (bathrooms, pavilion, pathways, landscaping, etc). Allison Kidd Probst motioned to approve Stephanie Brown to write OSLAD Grant application for Purdy Park for up to $2,500, Joy Fay seconded. Roll Call Vote: Allison Kidd-Probst-aye, David Simpson-aye, Denny Sands aye, Marc Cinnamon-aye, Joy Fay-aye, Goeff Cooker-aye. 6-0 Motion carried.

EXECUTIVE SESSION

Joy Fay motioned to go into Executive Session at 7:31PM, David Simpson seconded. All in favor vote aye, motion carried.

Allison Kidd Probst motioned to return to the regular board meeting at 7:41PM, Geoff Cooker seconded. All in favor vote aye, motion carried.

ACTION FROM EXECUTIVE SESSION: No action from executive session.

ADJOURNMENT: Allison Kidd Probst motioned for adjournment at 7:42PM, Geoff Cooker seconded. All in favor vote aye, motion carried.
